it's my first job & i want to resign... the company is deducting my salary for cash bond every 15th & end of the month... if i resign will i get my cash bond??
i signed a 2-year contract but i'm only employed for 7 months now... but fortunately/unfortunately my boss doesn't have his signature on my contract...

Did you undergo a formal training?

Cash bond should not be deducted every pay day. It should be paid by the employee in event that he no longer want to push through his contract.

i had 6 months training...
before i started the HR oriented me & said we have Php5,000 cash bond & every pay they deduct Php300 until the Php5,000 is consumed...
are there different kinds of cash bond?? is my cash bond different from what you're saying??

Since you had a six-month training your  company can impose a bond but as I've said earlier cash bond should not be deducted every pay day. It should be paid by the employee in event that he no longer want to push through his contract.

You may send a courteous letter asking them to stop deducting your bond and you may use this article from the labor code

Art. 113.Wage deduction. No employer, in his own behalf or in behalf of any person,
shall make any deduction from the wages of his employees, except:
a. In cases where the worker is insured with his consent by the employer, and the
deduction is to recompense the employer for the amount paid by him as
premium on the insurance;
b. For union dues, in cases where the right of the worker or his union to check-off
has been recognized by the employer or authorized in writing by the individual
worker concerned; and
c. In cases where the employer is authorized by law or regulations issued by the
Secretary of Labor and Employment.

Should your company insist that they will continue to deduct bond, you may ask them to present a letter from the DOLE Secretary that they are authorized to do so.

What other term or system can we use so that we can have something to hold on in case the employee went AWOL or if the employee does not want to pay the bond? Thank you!

nagwowork po ako sa isang agency na which is halos laht ng empleyado naguguluhan sila sa cash bond.. since dumting ako dito sa agency up until now almost 1 yr n aq.. knakaltasan pa din po ako ng cash bond, every pay day knkaltasan kmi ng 250.00 every payday.. panu na lang sa mga nauna sa kin.. tama po ba yung pag kaltas ng cash bond as long as nagwowork ako dito sa agency na toh..

Yung mean na cash bond ni Kael12 ay yung under agency employee ka then kinakaltasan ka ng cash bond as ipon daw kada sahod ksi ibabalik naman daw pag nagresign na.so parang ipon nila yun which is by LAW IS NOT ALLOWED.
It is only allowed to specific jobs that requires emloyees to have cash bond if they are handling money, merchandising and even stocks.

I dont see a statement I've written saying that Kael's cash bond is savings. In fact I was saying that it is illegal and that he should courteously ask his company to stop it. You must be hallucinating Smile

Good morning. I would like to ask for advise regarding the posting of bonds for drivers and sales personnel. These employees when hired are given allowances which they need to liquidate. Also, they have in their custody products of the company. How if these employees went on AWOL?

Is it legal if we deduct P500 from their salary up to 6 months (until they are regularized) as bond and include that provision in their contract of employment? If such provision is included in the contract and the employee signed it, will that make it legal?

hello. Been reading your advises and it helped a lot. But still, I need one for my case. I was employed as probationary branch head in a corporation and before signing the contract, i clearly stated that I am not willing to travel outside Bacolod city. After 3 months, the operations head gave me a directive to be assigned in other branches. I have noticed that the corporation HR Dept system is not fair. Either RE-ASSIGN or RESIGN. In my case, I resign. When I asked for my cash bond, my superior told me that its a case to case basis. I havent had any training, insurance and the agreement for the cash bond is only AUTHORITY TO DEDUCT and not the cash bond agreement authorized by SLC/DOLE.

There are other anomalies happening in their system when it comes to employees. They terminated one staff (4 years) but he is not yet regular and got only 4k for his 4 years of service. I dont want to be a part of their system thats why I resigned.

The head office told me once you resigned, you cannot get your cash bond. I know cash bond is illegal in the first place. I have written to them thru email the reason why I resigned and asking for my bond but they dont reply.

Please enlighten me what to do. Thanks.

Tanong q lng po. Ang co. Na napusakan q nuon ay meron pong bonds na P200k, Effective po to ng 2yrs. So I resign for my 1 and a half year of experience. Then sinisingil po ako ng company ng 200k dahil hindi q daw natapos ang 2yrs. Wala po akong naging training and wala din pong kaltas ang salary. Is it legal or not? Ty and God bless everyone.

Hi!

During my employment on my previous work, the employer deducted cash bond from our salary for 7 and a half months, P15k in total (according to them it will be used for any penalties to be incurred in the future). There was never a contract regarding the cash bond and we did not affix our signatures to any agreement or whatsoever. Last November 2015, it came to our knowledge that the cash bond of the existing employees have been refunded already. We thought that we, the resigned employees, are also entitled to claim the same. We filed a complaint to the Employees' Compensation Commission, an agency attached to DOLE. A hearing was held but our previous employer kept on insisting that we have to comply with the clearance first before they can release it, which we believe is not reasonable. Our next step now is to file a complaint in the NLRC. Do you think we can win the case? Is the Labor Code Art. 113 enough as proof to illegally collect cash bonds from their employees?

Good day po. Ask lang po. i used to work for 10 month and I signed a 2 year contract sa isang firm. I plan to resign but when I ask our accounting regarding kung magkano pa yung babayaran sa bond ko, they said 25k fixed bond daw po yun. Any advice?

Check your contract. If a provision regarding the matter and the amount is stated, then DO NOT resign.

Hi. I have several questions po.

I've been employed for more than 2 months now in a school. I signed a contract which states that I need to finish/ pass 6 months probatinary period, and if I decided to resign earlier than 6 months, I should pay a bond of 20,000Php. Aside from that, it is also stated in the contract that I should render 60 days after the resignation had been filed.

I was hired March 17, 2016, and my first pay was given the 15th of April because of what they call "PONDO". Every cut off from April 15, indicated in my payslip is a deduction of "CASH BOND", which as far as I can remember is not explained to me, and not stated on the provisions of my contract.

Also, a friend told me that cash bonds are only applicable if the employer provided / is providing / will provide a formal training, which I am not getting from them, neither all of my co-employees.

With all of these conditions, my employer is still not giving me a copy of my signed contract. My boss, whose name is stated on the last part of the contract, has no signature of him yet on the day that I signed it.

Here are my questions:
- If I am going to resign, am I liable for that cash bond?
- If I am going to resign, would I need to render 60 days, or should it be only 30 days upon resignation?
- I read an article that deducting cash bonds is illegal, what should I do with my case?
- Is it also true that the cash bond is only applicable if the employer is providing formal trainings (those with certificate)?
- I already requested a copy my contract but they refused to give it to me because the "boss" hasn't signed it yet. What else do I need to do?

YES, you will technically be liable for the amount agreed upon in the contract.

If you signed 60 days, then its 60 days. Just like if the contract says 5 days lang, then its 5 days lang

Ask employer for a refund of the amount deducted from salary already

NO, bonds can only be claimed if the employer is entitled to it. If what you say is true, that there no training nor any acts from the employer for the advancement of the employee and totally has incurred no costs, the entitlement to the bond is not justifiable even if it is written in the contract.

NOTE: It is not automatic or absolute that if bonds are included in the every contract, it is enforceable.

30-day turnover period would suffice unless a longer period is stated in your contract.

Deduction from the salary of the employee without any agreement to do so is NOT valid. You may file a complaint for this if warranted.

- Is it also true that the cash bond is only applicable if the employer is providing formal trainings (those with certificate)?
NO, trainings and/or seminars or any acts that would benefit the employee, even if without certificates, can also be subjected to bonds.

- I already requested a copy my contract but they refused to give it to me because the "boss" hasn't signed it yet. What else do I need to do?
FILE a complaint. That way, your company will be compelled to issue you your contract.
