MOTOR NA GUSTONG HATAKIN NG DEALER

Kelangan lng po ng advise tungkol sa problema . Kumuha po kami ng motor from Motortrade last Sep2007. Matatapos na po yung payment ko this Sept 15. Kaya lang po natanggal sa trabaho yung mister ko recently at hindi kami nakabayad ng monthly since July. Nakiusap na po kami ng ilang beses sa dealer kung pwede unti untiin namin yung bayad. Pero hindi po sila pumayag.

Gusto po nla kunin yung unit at kelangan bayaran namin w/in 30 or else hnd na namin xa pwd i claim ulit. Yun din daw kasi nakalagay sa contract. Kakasuhan daw kami if hindi namin isusurender yung unit sa kanila. Kulang nalang po kami ng total of 15k for Jul/Aug/Sep at more or less nakapagbayad na kami ng 85k sa unit na ang cash price e 55k

Natatakot po kami sa banta na kakasuhan kami, pero ayaw naman namin bitawan yung unit dahil sa laki na rin ng naibayad namin dun.

review your contract and see what it says about when you are unable to pay. it's either you have a contract to sell or a contract of sale with chattel mortgage?

under whose name is the vehicle registered (motorcycle?) keep it in another garage so that it cannot be easily repossessed. you have substantially paid for it and equity should be on your side that this should be a mere collection case and not one for repossession.

you cannot prevent them from filing a case, but you have a valid defense of substantial compliance with your obligations in the contract. you cannot compel them to accept partial payments.

i recommend you keep talking to them to negotiate. offer partial payments and actually offer the money, but you cannot force them to accept it.

Thanks a lot po sa inyong sagot!! Today ko po mababayaran ang kabuuang balance ng unit. I just hope tanggapin nila tong payment na 2 kasi baka i insist nila na for repossesion na talaga yung motor.
