That depends.
If the country where you applied for the visa would grant VISAs to applicants:
1) without NBI Clearances, and
2) is ok with the fact that the applicant has a pending criminal case,
then that's ok.
Getting an NBI clearance may form part of the VISA Application, but they are two separate things. One is not automatically dependent on the other.
