I loaned P10,000 to my friend's sister and used my ATM card as a collateral. She applied 10% interest every month which I know is very excessive but due to urgency, I accepted. I renewed my loan for another P15,000 to pay for my tuition and this time she applied 15% every month which again I accepted since I badly need the money in order for me to get the exam, and I am confident that I can pay it all off in time. However, the company I worked for dowsized and unfortunately, I was one of those people who got terminated. I was jobless for two months and interest kept on adding up. When I finally got a job, I realized my loan reached P32,000 or more. They took my new atm card and took almost 75% of my monthly salary. I was always short of budget. I was pregnant and I didn't feel that good often and I missed work hours. So, sometimes my salary wasn't enough to pay off the amount required for the month. And because of that, they applied another 15% interest on my loan. Which made it more difficult to pay. When I got the first half of my SSS maternity benefit which is P15,000, they took P10,000 from it plus my salary for that cut-off. They left only left P5,000 for my labor. I cried and beg, reviewed our agreement that they will only deduct amount from my salary and not from other benefits (Our company sends our sss benefits through our atm cards). They empathized but never did they return my money. That made me really mad and frustrated, so I declared my atm lost. I got my new atm but I never did forget to pay what I owed. I give them 500 to 1000 every payday since that's what I can only afford. Right now, they are threatening me that if I won't give them my new atm card, they will sue me and have me sent to prison due to non-payment. Hello? I am paying but they won't just settle for the amount.

My net pay every payday is 4,500. I have a baby to feed, bills to pay, and other expenses (transportation and food). They want to take 2,500 from me every payday. I really want to have this loan paid off but the amount they require and the interest is excessive. We don't have any written agreement and they don't have any license to operate. They have been doing the same thing to some of my colleagues as well. What can I do to have this settled?

Interest can only be collected if there is agreement between you and the person you loaned money from.

You will not be imprisoned for not paying your debt. And the interest they collected from you is too much. Even if they go to court, the court will not agree with what they are doing.

Just pay the original amount that you have borrowed since wala naman kayo kasulatan sa interest.
