Good PM! Magtatanong lang po ako about sa lupa na iniwan sa amin ng Parents ko,pareho ng patay ang mother at father ko pero yung titulo ng lupa nakapangalan parin sa mother ko, wala silang kahit anong kasulatan na iniwan. Apat kami magkakapatid, kakamatay lang nung isa so ngayon 3 na lang kaming buhay. My apat na anak yung kapatid kong namatay, 2 anak sa tunay na asawa at 2 Anak sa ibang babae. Pano ba namin hahatiin yung lupa sa legal na paraan? My legal share parin ba yung mga anak ng brother ko at ilan percent? By the way,
Patay na din asawa ng brother ko. Maraming salamat po sa sasagot.

Now that your parents are both gone, you need to:

A. File the Estate Tax Return and pay estate tax
separately (for your parents).


After payment of estate taxes,
you will receive from BIR, the foll:

1. OR :Official Receipt on payment of estate tax.

2. CAR :Certificate Authorizing Registration.

3. TCL :Tax Clearance

B. Registration/transfer of title and tax declaration
of a real estate property.

Then, you will receive the ff in the names of heirs
based on the extrajudicial settlement:

1. Original TCT and
2. Original Tax Declaration

C. Cancellation of the TIN of each deceased parent.

Yes, the property of your parents will be divided according to the law of our country; and

your deceased brother has a share (that will go to his heirs).

Kailangan niyo mag pa extra-judicial settlement.

Ang lupa ay hahatiin equally sa inyong apat na magkakapatid (25% each). Ang share ng namatay mong kapatid ay mapupunta sa dalawang lehitimong anak niya, hahatiin nila ito ng patas. Walang makukuha ang asawa at mga ilehitimong anak.

Magkano po kaya magagastos sa extra judicial settlement? Worth 20million po yun lot.

Ang una mong gagawin ay mag execute kayong magkakapatid ng Extra Judicial Settlement of Estate. Maaari kang kumonsulta sa abogado para gawin ang dokumentong yan. Tama yung sinabi ni hlslawph na hahatiin equally sainyong apat na magkakapatid at ang lehitimong anak lamang ng kapatid mong namatay ang magkakaroon ng share at yung iba nyang anak sa ibang asawa ay walang karapatan sapagkat ilehetimo silang anak.

You are also required to published the Extra Judicial Settlement of estate in a news paper of general circulation once a week for three consecutive weeks.

Yung amount na magagastos mas mabuti kung mag iinquire ka at mapapa compute sa BIR para sa estate tax. Magbabayad ka rin ng transfer tax sa city hall at Registration fees sa Registry of Deeds.
