Hi, . I am applying po kasi for a Pagibig housing loan for a construction of house. Yung pong Lot to construct the house is required to be under my name so kailangan ko po sa pagkakaintindi ko po ng Transfer of certificate of title ng lot under my name. Yung owner ng property po ay ang mother in law ko po. She is willing to transfer the title to me as a gift sa Amin mag asawa. Kailangan pa rin po ba ng deed of sale kahit I'm not really buying it from my mother in law? Salamat po.

No. Wala naman pong bentahan na naganap kaya hindi kelangan ng Deed of Sale. Ngayon po, what you need is to transfer the title into your name, right?. Since, wala nga talagang bentahan na naganap, ang kelangan pong legal document na i-eexecute ng mother in-law nyo ay Deed of Donation which is one of the major requirement in Registry of Deeds para ma transfer sa Name nyo ang Title. As far as i know, Mas mahal nga lang ang Tax nya sa BIR, kaya yung iba pinapalabas na lang na nagkaroon ng bentahan kasi nga mas mababa daw ang tax kesa sa donation.

Hi Atty.ako po ay bumili nang lupa,through sa pangalan ng kapatid ko.kasi wala po ako Pinas.ngayon Problema ko po,dinimolish po yong bahay nang may ari nang lupa.so ngayon pinabalik na nya po ang bahay.mayroon po akong papeles which is deed of seal at contrata,at notarized po ng Atty.yong problima,may isang taong nag stop po nang pagpagawa ng bahay namin.for the reason binili nya rin daw yong lupa sa may ari.so,I really need u'r advise kasi pinadalhan po ang kapatid ko ng sumon na pupunta kapitan.thanks a lot

Binili mo yung lupa tapos hindi mo hiningi yung titulo at hindi mo pinalipat sa pangalan mo? Eto yung gawin mo sa ngayon:

1. Kunin mo yung original na titulo sa may ari. Sapagkat, Nabili at nabayaran mo na yung lupa, ibig sabihin, sayo na yun.

2. Kapag nakuha mo na yung Titulo, pumunta ka sa tanggapan ng registry of deeds sainyong lugar para i check kung totoo/peke at malinis ang titulo ng may-ari, malalaman mo ito sa pamamagitan ng pagkuha ng certified true copy ng titulo sa nasabing tanggapan.

3. I-review mo yung agreement nyo sa kontrata/deed of sale kung sino yung sasagot sa ibang bayarin ng pagpapalipat ng titulo sa pangalan mo. (kagaya ng CGT/DST Taxes).

4. Kausapin mo yung may ari at agad mong ilipat sa pangalan mo yung titulo para masabing legal na pagmamay ari mo na yung lupa.


Sa tingin ko, naloko ka nung pinagbilhan mo ng lupa sapagkat bukod sayo ay meron pang ibang nagcclaim ng lupa. Ang makakasagot lamang ng problema mo ay yung may ari na pinagbilhan mo.
