gud day po,dto po sa factory na pinapasukan ko uso ang salary deduction once na magkaron ka ng reject sa mga fabrics,lalo na pag limited stock ang marereject mo,tanong ko lang po tama po ba na magbayad ang isang employee once na magkaron cla ng reject kahit wala sa rules and regulation ng isang company?pede po ba cla magreklamo?pero kung sa labor po wala clang laban dahil panig ang labor d2 samen sa mga company,kanino po ba cla pedeng lumapit?nakakaawa kasi ung mga employee na 336 lang ang rate pero dededuct almost 5-10k then 5mos deduction,.hindi po ba cla mapag initan once na magcomplain cla?wait ko po reply nyo..thanks

dito sa Philippines, ang deduction ng employee when he/ she caused damage and lost sa company may not exceed 20 percent of the employee's wages in a week.

AttyLLL,
question lang po,what if proven na nag caused ng damage ang employee sa company but the latter refused to have a deduction with his salary?. Can the employer pursue the said deduction?.

most employers get away with these deduction, but i do not believe there is any legal right unless there is a prior written authorization. imo, the company has to file a civil case for payment if the employee refuses.

Follow up question.. not exceeding 20% of employees salary , basic lang po ba or kasama yung COLA/ allowance para makuha ang deduction?
