hi atty. ako po si Riza,25..meron po kasi aq nasapak samin pero pumutok lng po ang labi,nag harap po kmi sa brgy. pero ang gusto nya po mag bayad aq sa knila ng 12,000 pero wala na man po aq maibibigay sa kanya ng ganun halaga. nag pa medical po sya willing naman po ako mag bayad sa gamot na nagastos nya. pwede po kaya ako makulong kung di ko sya babayaran ng halagang gusto nya?...salamat po

if she called you puta in front of other people, that is oral defamation. that is the charge you should file against her. do you also have a certificate to file action?

nag kontra demanda po ako sa kanya, kaso lang po parang binabali wala ung paninirang puri na denimanda ko sa brgy. ang sabi po ng kagawad smin dala lang daw po ng galit un kaya nya po nasabi sakin yun,.eh may testigo po ako na sa harapan ng maraming lalaki nya ako sinabihan ng ganun, sa may pilahan po ng tricycle nya ako sinabihan ng ganun.

attempted murder? it is highly unlikely that the prosecutor will agree with that claim.

at the bgy, make a formal complaint to the lupon. never mind their comments, it is your right to do so. all you're after is the certificate to file action so you can file a complaint at the prosecutor's office.

you or they can ask for 1-1Million, it all depends whether the other party will accede to your demand. there is no fixed amount. i suggest you try to negotiate to make it all quits. you won't have leverage unless you file your counter charge. good luck.

bail is the security you put up for your temporary liberty. it is not required in a case of slight physical injury unless you do not appear at your arraignment. paying bail does not end the case.

the punishment is upto 30 days of imprisonment, or P200 fine and censure, at the discretion of the court.

what i suggest is that you enter into a compromise agreement during mediation.

what you described sounds like slight physical injury. i hope there is no permanent scar on his face, else it can be considered serious physical injury.

if he has a medico-legal certificate, check how many days it says he needs attention of up to 9 days, then it is just slight physical injury which has punishment of up to one month.

the bgy lupon ha no authority to decide whether you are guilty. it can only try to mediate between the parties and convince them to reach an amicable settlement. i recommend that you take this opportunity to apologize and make restitution.

mayroon po akong nakaaway, nasuntok ko po sa mukha at dumugo po ang kanyang labi, nagpa medical po sya agad at pumunta sa prisinto, dinanpot po ako ng mga pulis at kinulong sinampa po agad sa piscal ang kaso na physical injury,pinag bail po ako ng 2000pesos, tanong ko lang po, dapat po na barangay case po muna yung kaso, bakit ako nakulong ng hindi kami nag usap sa barangay?
