Good day.

mayroon pung naiwan na lupa ang mga magulang ko about 20 hectares. the land was taken care by a tenant with her family mula pa nuong buhay pa ang grand parents namin.

After the death of our grand parents, hindi na binibisita ng parents nmin ang lupa at nagtiwala nman po sya sa mga remittances nong tenant.

Ngayon po ay pumanaw na rin ang parents nmin at paghatiin na naming magkapatid ang lupa. Ang sabi nag tenant ay marami na daw syang natanim na mga fruit bearing trees doon. Eto po ang mga tanong ko atty.

1.) Gusto po namin palitan ang tenant..pwede po ba at ano po ang mga rights niya or legal demand niya na dapat po naming ibigay?

2.) tungkol po doon sa mga naitanim nyang fruit bearing trees, dapat ba namin syang bayaran? paano nman po kami makapaniwala na sila ang nag tanim at wla nman silang written na kasundoan.

3.) kung hihingi po sya ng share sa lupa, oblige po ba kami at gaano nman po kalaki kung sakali entitled po sya.

i'm not an expert in this. you should check first with the DAR where the property is located whether he is a registered tenant.

have you settled the estate of your parents? have the titles been transferred to your name?

We haven't settle the estate yet coz we know it will involve big amount of estate taxes thats why until know the title cannot be transfered in our name. Sabi ng bro ko "atin-atin" na lang ito. Pag hatiin nlng natin..

Hi, gusto ko po rin sana itanong if kung ibebenta po b ng mama ko ung lupa nya sa province po namin, pwede po bang mag-demand ang currently ng-oocupy na tenant. Ang concerns po kc ng mama ko, cnasabi po kc ng tenant na hindi daw cla pede paalisin. If DAR regitered tenants po cla, how much po b ang pede nila i-demand na bayad.

Ung lupa po ay nakapangalan pa po sa Lolo nya, since gusto nya parin po ibenta, kahit murang halaga lang ang kaso nga daw po problem nya ung tenant. Inde rin po nya mabenta kc inde nya po mapaalis ung tenant.

Rice po ung tamin sa lupa ng mama ko.

any idea po ba kung magkano po kaya ang mag-transfer ng pangalan sa land title?

it can be sold if the buyer is willing to absorb the tenant. you cannot expel the tenant if he is registered at the dar.
