Utang na may Collateral

May utang po sa amin ang isang tao.
Wala pong kasulatan ng utang na yun.
Nangako po sya na babayaran nya un last July 2010.

Pumayag po siyang makipagkita para pirmahan ang kontrata.
Pero nung pagdating po nya, hindi nya po dinal ang
original na rehistro ng kotse nya at sinabing naiwan
daw nya.

Pinapirma pa rin po namin sya sa kontrata at kinuha
ung xerox na dala nyan rehistro pati xerox ng passport
at lisensya nya.

Nangako po syang dalhin sa amin ang orginal na rehistro
kinabukasan. Pero hindi na po sya nagpakita at hindi
na rin nya sinasagot ang mga tawag namin.

Ano po ba ang pwede naming gawin para mahabol sya sa
utang nya. Paano rin po namin masisigurado na hindi
nya ibebenta ang sasakyan sa iba bago mag August 30?

Sobrang nededesperado na po kami. Tumawag po kami
sa LTO pero sabi nila, labas daw po sila sa kontrata
namin.

We consulted with a friend lawyer din po and he said na need muna namin magpadala ng demand letter asking for the payment of the loan or the delivery of the car since she was already in violation of the contract.

Hanggat hindi daw po napapa receive sa debtor ang demand letter, hindi daw po kami makakausad since yung bilang ng araw daw po kailangan from date of receipt of demand bago maipasok sa piskal.

Nagtext po ang debtor and pinpakuha na sa amin ang kotse. Pero wala po ang or/cr. Iniwan daw po ang susi sa katulong. Advise din po sa amin ng friend namin is wag daw kukunin ang kotse unless mapa pirma namin sya na voluntary nya ibinigay kasi baka daw kami ang baliktarin with carnapping in the end.

Sobrang naiipit na kami dahil hindi naman namin pera ang inutang nya. Kami na po ang hinahabol ng mga tao. Tinatry po namin sya timingan sa bahay para mapapirmahan ang demand letter and joint affidavit na pumapayag sya mapa sa amin ang possesion ng car, pero di po namin sya matimingan.

Ipinipilit po nyang kunin na namin ang sasakyan kahit wala syang pirma kasi sya naman daw po ang nagsabi, pero nagiingat lang din kami. HIndi po namin sya mahagilap.

i would recommend going to the LTO where the car is registered to check on the OR if it is correct.

when you claim the car, you can ask the barangay to send a representative to accompany you and witness that the car is being turned over voluntarily because there are instructions to give you the key.
