RA 9262 Child Support

Hello po, need advice.

Ano po dapat gawin kung yung bro ko married siya with 2 kids. Tapos nagka-gf siya at nagka-anak, inacknowledge nya ung bata. tapos after almost 2yrs nagsampa ng case yung babae RA9262 child support, nasa court na po ngayon ung case. naki-pag settle ung bro ko in front of the fiscal (alone ung bro ko kc wala syang lawyer), nagbigay sya ng paunang sustento. tapos nung hearing binanggit ng fiscal sa judge na nag-settle na sila witness ung fiscal.

tapos after 1 week gumawa ng agreement ung PAO(sya ang tumulong maisampa and case) na magbibigay ng support ung bro ko, half on the 15th at half on the 30th of month ung bigay. nabanggit din sa agreement request to dismiss ung case. nag-sign bro ko, ung babae at ung PAO.

pero dahil pamilyado ang bro ko, nagigipit din siya. hindi po sya nakapgbigay ng half sa ibang month at half sa ibang month pa. after that nirereceive parin ng babae ung ibang perang padala ng bro ko para sa bata. kaso nung pagdating ng hearing sabi ng babae itutuloy parin ung demanda.

ano po dapat gawin ng bro ko? wala syang lawyer, kaya walang makatulong sa kanya on time of hearing. salamat po.

he should ask the court to be allowed to be represented by the PAO lawyer assigned to the court.

even better if he can give a lump sum so the case can be dismissed and he will continue with the monthly payments. else the case can continue.

anu po ang gagawin ko kung di tumutupad sa kasunduan namin? this is now the 4th month na instead of 5k bibigay nya payable in every 15th and 30th day of the month tska tutulong cya sa maternity expenses ko...dpo nya tinupad anu po dpat kong gawin atty?

if what you have is a court approved agreement, then you can file a motion for execution

Kasunduan lng po cya sa PAO nung wala pang kaso na nka file.. wala po syang sinunod na kasunduan ni isa although nagbbgay xa every month but not the amount that we agreed upon nor ung pinirmahan nya about my mat expenses po...

Anung dapat gawin atty?
Pde ko parin bang i-pursue ung criminal case for econ abuse?

Pnu ko po gagawin ung petition for enforcement of the agreement? Me bayad po ba un atty? Allowed po ba akung gawin un khit wala pang kaso na nai-file? kahit agreement lng sya infront of PAO lawyer? Un po kasi ung first meeting namin to come up with an agreement for support kaya nga lng po ay di nya sinusunod...

ngayon lang po ako nagkatime mag-check ng net.
pano kung yung kasunduan in front of fiscal walang writing?
yung writing is after na lang po nung sa harapan ng fiscal, tapos yung gumawa ng agreement yung PAO. yung agreement di pa napirmahan ng fiscal at ng judge, di parin po na-submit.
ang bigay every 15th and 30th of the month?
4 days before ng hearing sabi nung babae tuloy ang case kasi po daw twice hindi nakapagbigay yung bro. ko.
tingin nyo po pag ipo-provide yung lump sum malaki ang chance ma-dismiss?

lump sum + written agreement and desistance signed by mother, then possible dismissal.
