Hi,

We are currently renting an apartment owned by my wife's aunt. Since they are relatives, no written contract was made and we just occupied the unit. Lately, our relationship with the owner, my wife's aunt have gone sour and they wanted us out of the unit as soon as possible. They said we need to leave right away and the unit will be rented for other people on april. What rights do I have as a tenant for not to be evicted right away? I just started on a new job, I can't afford to leave just that and produce the funds in transferring to a new apartment. if only this can be prolonged for 3-4 months, i can re-establish my finances and will afford transferring to a new apartment by that time. But for now, I just have to stay. what rights or protection do i have from a possible harassment by the owner? and please take note that there's no written contract stating i am renting the place. thanks

meron kang karapatan na mamalagi at hindi paalisin ng walang sapat na maganda at legal na dahilan hanggat hindi pa natatapos ang iyong kasunduan kung saan ay ikaw ay dapat na umalis. sa kaso mo, sabi mo wala kayong written contrat of lease. so malinaw na na hindi fixed ang time ng pag-okupa mo ng apartment. ayon sa batas, hindi ito nangangahulugan na forever happy ka dyan at dyan ka din tatanda. depende yan sa klase ng pagrenta mo. kung ang renta mo e monthly, sa katapusan ng buwan e... pwede ka ng pa-lisin. kung yearly, sa katapusan ng taon ang ba-bye mo. ang kailangan lang ng may-ari ng apartment (note the word- may-ari...m.a.y. a.r.i. -at hindi ikaw yun) ay abisuhan ka na ite-terminate na niya ang kontrata sa katapusan ng buwan/taon...

kaya simulan mo na ang pag-empake at maghanap hanap ka na ng ibang apartment. feeling ko, pride lang ang rison kaya ayaw mong umalis. buti nga wla ka sa sabah,,, doon kasi binabarila ng ayaw umalis Very Happy

Actually sir its not pride. Ayaw namin umalis kasi may hawak kaming Deed of Donation na nagsasabing na may portion ng lupa na kinatitirikan nitong apartment ay binigay ng may ari sa pamilya ng wife ko. 400 sq meters po ang land area, and 100 sq meters po ang dinonate ng owner sa family ng wife ko pero hindi po nka indicate ung exact location ng 100 sq meters. Thinking na matagal at komplikadong usaping legal ang Deed of Donation na hawak namin, sa ngayon po ay gusto ko munang iexercise ang karapatan namin bilang tenant. Kailangan ko lng po ng kahit 4 na buwan na manatili muna dito hanggang makapag ipon at lumipat sa ibang apartment. Posible po ba yung 4 na buwan from the time na maghain ang may ari ng ejectment hanggang magkaroon ng court order para umalis kami dito?

lahat naman e posible. usually kahit naman summary ang procedure e inaabot naman ng taon ang kaso... kaya lang, isa-alang alang mo na maaring maliban sa rent, e may kasamang damages ang judicial award.

pero pare, yung deed ninyo e, sabi ng fren ko, wlang binabat sa kasabihang, "a tenant can nver question the title of his landlord" . tma naman ang fren ko doon, wlang sense kung magrerent ka e sa iyo naman ang property. engot at malaysia lang gumagawa noon. pero sa tingin ko, yung malaysia engot din, kaya logically, engot at engot lang gumagawa noon.
