Greetings!
May pinirmahan po akong promissory note sa 1 tao last 2008 na may personal loan ako sa kanya ng 100,000.00 and 400us dollar.sa mga hawak kong papel na katunayan nakapagbayad na ako sa kanya ng 87,000.00 at ung binayaran ng mister ko nasa 15,000.00 pero walang kasulatan.ngayon nagtetext sya sa amin na nagfile na daw po cya ng case para sa akin dyan sa pilipinas.nandito po ako sa singapore ngayon.at nagtetext cya na dapat umuwi daw po ako para harapin ung kaso.pero wala pa pong natatanggap na letter dun sa pinas na demand letter.at sinasabi pa po nya na pati mister ko madadamay sa kaso na baka pati work po ng mister ko ay madamay.ipapakita daw po nya ung demand letter na sinasabi nya dito sa immigration dito at ministry of manpower.can he file a case against me even he is also working in singapore?ako po tourist lang dito at pumapasyal lang sa mister ko.ano po ang pwede kong gawin kasi po hindi ko naman tinatalikuran kung may balanse pa po ako sa kanya.?gawa lang po talaga ng nawalan ng work ang mister ko kaya d ako nakapagbayad ng matagal.if matuloy nga po ang kaso may laban po ba ako?best regards po sa inyo...

failure to pay a debt is not a crime and is not basis for any possible sanction by the DFA.

if he has filed a case, then answer that you are waiting for the summons to be delivered by the court and you will present your side at the proper time.

prepare your evidences of payment. does the contract state that there will be interest?

you can try to argue that the complaint is premature because there has been no demand, but that depends on what is written on your agreement.

nakalagay po sa promissory note na may 10percent interest.malaki po ba ang chance ko na manalo if ever totoo ngang na file na ung kaso? at pwede po ba siyang magfile ng case kahit nandito siya sa singapore.thanks and best regards...

10% per month? week? year?

he can issue an SPA authorizing someone in the philippines to represent him.

if it's 10% a month you can validly argue that the amount of interest is unconscionable.

ngayon po nagtext na naman siya sa akin at sabi may hearing daw po na nakaschedule this august 25 pero bakit po siya alam nya eh samantalang ako walang alam kc wala pong dumarating na demand letter sa akin sa pinas?paano po yun kung wala naman akong natatanggap na sulat at ung nagdemanda alam na nya po na may schedule na ng hearing?

moderator

hearing where? barangay? send a representative. you can easily argue that 10% a month is unconscionable.

if the case is in a court, it cannot continue unless summons is delivered to you or published.
