Gud day atty.

Atty tama po ba na ihold ng employer ko yung sweldo ko khit nde pa nya napaptunayan n my violation akong ginawa? regarding po ito sa overpricing na sinasabi nya na violation ko,actually nde po ako dumaan sa due process ,ngulat n lng po ako nung time ng sweldo na wala akong sweldo ,then nlamam ko na lang n nkahold pla yung payroll ko,kya 2loy nde ako mkapasok kc until now nkahold pa rin salary ko,1 month na png nkahold. ala na po akong mgamit na pera para mkapasok at para mkabayad sa mga utang ko. Gusto pa nya plabasin na nag -aawol ako.pkiramdam ko po ginigipit nya ko para lumabas na guilty ako.which is nde nya kyang patunyan.Atty need lang po ng advice kung ano dpat kong gawin?

Your employer cannot hold your salary. The employer can only hold an employee's salary under very exceptional cases e.g. check off for union dues, payment for employee's insurance which was advanced by the employer, when the employee loaned money from the employer and the same is already due and demandable.

tobias, it is not fair to hold your salary without proving that you are liable.

however, if you are not being prevented from going to work, then you may become liable for being awol. it will look like you are refusing to go to work because your salary was withheld. the proper recourse is to go back to work and answer whatever charges are being made against you. if they are not justified and you are not issued salary, then you can file a money claim at dole or if it warrants a complaint at nlrc for constructive dismissal.
