This is regarding on postpaid applied to globe telecom

I have applied for a postpaid line, Plan 1799 for 2 years
Basically, I have applied for a phone that is capable of LTE, this a new feature in communication technology
The representative gave me the phone, and she said that it is LTE capable, later on i have come to know that this phone was not really capable of LTE,
I am requesting that this phone be replaced or be returned
At first the provider is clear that they breached the contract,
Can i return the phone or not pay the plan?
Thanks for your advices
