Legal Wife, Husband & Live in Partner

May hold ba ang Legal Wife sa mga properties na napundar ng Husband at ng Live in Partner? Si legal wife and si Husband ay nagsama for almost 10 years nagkaroon ng dalawang anak and then naghiwalay on themselves lang, kumbaga without annulment, legal separation, etc. Afterwards nameet ngayon nitong si husband etong si Live in partner. Nagkasama sila for almost 25 years (hanggang ngayon), may limang anak and nakapagpundar ng mga negosyo. Eto ngayon si Legal Wife saying na after mamatay ni Husband, kukunin nya ang mga dapat ay kanya. Anong dapat gawin ng Live in Partner and Husband against the Legal Wife?

Legal wife cannot immediately get her share without a court order for the partition of the properties. Legal wife must first file for legal separation or annulment to partition the properties. The court will issue a final decree of nullity of marriage only then the partition can take place.
Kung mamatay si husband at kung may last will si husband, the last will will prevail otherwise, the law provides for intestate succession.

The legal wife will always have better rights than the mistress. Whether or not the husband leaves a will the mistress is always excluded by operation of law that is because the mistress is incapacitated to succeed.

Art. 739 (1) which is also applicable to wills, provides that:

"The following donations shall be void:

(1) Those made between persons who were guilty of adultery or concubinage at the time of the donation; xxx"

Take note that the above provision does not require a previous conviction.

Cant we have a security/legal action ngayon as a mean in securing our properties habang buhay pa si husband? If there's any ano po yun?

walang karapatan si other woman sa mga ganong bagay (like SSS or any other pensions) those things should goes to the legal family. Pagdating naman sa properties, may ibang set of rules ang hatian ng properties ng mag-live-in. may karapatan lamang siya sa mga properties na naipundar during the time na nag-sasama sila.

What do you mean by this?

nakuha ko na ibig mong sabihin... walang paki-alam si other woman dun sa past issue ni babae. ang pinag-uusapan ay kung sino ang ka-i-do-han ni lalaki na nakapirma sa marriage contract. kung sumakabilang bahay man si babae previously, si hubby lang ang may karapatan na magsampa ng kaso laban sa kanya.
