Year 2009, my sister ventured to purchase a foreclosed property, "as is, where is basis". The bank property management informed us that there was ongoing ejectment case against the occupant of the subjected property & already on the final stage, nearing court decision. The property was refinanced for 3 years by the same bank + mortgage interest. The case was dragged for many years. After the property was fully paid last April 2012, the bank transfer the case to us inluding bank hired law firm's service fee & charges. The case became stagnant when RTC ordered to hire geodetic engineer & to confirm if the disputed property is really the bank's foreclosed property? We hired the service of a geodetic firm to confirm & relocate the property. The survey's result shows that the the bank sued wrong occupant? The correct lot location per TCT was the adjacent lot, 2 blocks away from disputed property, according to Geodetic enginner's relocation survey report. Means, kailangan namin mag-file ng panibagong ejectment case sa panibagong occupant after 4 years of waiting tapos mali pala ung tinuro at kinasuhan ng banko.
Ayaw na po namin na ituloy dahil maraming frustration at oras ang nawala. Gusto namin na bawiin na lang ung pera na binayad namin.
Saka hanggang ngayon ay di pa po ma-transfer ung title sa amin dahil may problema po sa transfer tax, nakapangalan pa sa dating may-ari? kahit na ung TCT ay nakapangalan na sa banko.Malaki din po ung penalty na binayan namin sa BIR dahil na-late na rin ung filing namin for transfer of titles.
Puede po ba kami mag-file ng case against bank property management to recover our financial losses? Ano po ang chances namin na ma-recover ito?
