Greetings po.
Year 2009, my sister ventured to purchase a foreclosed property, "as is, where is basis". The bank property management informed us that there was ongoing ejectment case against the occupant of the subjected property & already on the final stage, nearing court decision. The property was refinanced for 3 years by the same bank + mortgage interest. The case was dragged for many years. After the property was fully paid last April 2012, the bank transfer the case to us inluding bank hired law firm's service fee & charges. The case became stagnant when RTC ordered to hire geodetic engineer & to confirm if the disputed property is really the bank's foreclosed property? We hired the service of a geodetic firm to confirm & relocate the property. The survey's result shows that the the bank sued wrong occupant? The correct lot location per TCT was the adjacent lot, 2 blocks away from disputed property, according to Geodetic enginner's relocation survey report. Means, kailangan namin mag-file ng panibagong ejectment case sa panibagong occupant after 4 years of waiting tapos mali pala ung tinuro at kinasuhan ng banko.

Ayaw na po namin na ituloy dahil maraming frustration at oras ang nawala. Gusto namin na bawiin na lang ung pera na binayad namin.
Saka hanggang ngayon ay di pa po ma-transfer ung title sa amin dahil may problema po sa transfer tax, nakapangalan pa sa dating may-ari? kahit na ung TCT ay nakapangalan na sa banko.Malaki din po ung penalty na binayan namin sa BIR dahil na-late na rin ung filing namin for transfer of titles.
Puede po ba kami mag-file ng case against bank property management to recover our financial losses? Ano po ang chances namin na ma-recover ito?

Yes, you can compel the Bank for restitution your payment; they sold you the wrong Lot; this case shall be best handled by a Lawyer. Gather all documents related to the Sales, Payment Receipts, Secretary's Certificate from the Bank, Deed of Absolute Sale, etc.

This is very serious and must be dealt with right away. Post no more and Hire a Lawyer, this is a Win situation on your favor.

Salamat po, ang laging panlaban ng banko pag nagbebenta ng property ay ung "As Is, Where Is basis". Makaka-apekto pa ba ito in case we file a case, mahaba kasi ang pisi ng banko kaya medyo hesitant kami kung sino ang kakasuhan namin, ung newly discovered na property occupant or ung banko? Kasi pa ung occupant, siguradong another 4 years or more na naman ito, before we see some result.

May sinalo (assume balance) poh kami na property sumwer in cavite..Ang monthly amortization poh ng property is P18,567.00 and we agreed na yung nabayad na nung first owner para sa house eh babayaran naming mag asawa within 3 years for P12,500.00 monthly..

Last june 27, 2012 kami lumipat sa bahay and we've done a lot para maayus yung bahay at garden.. Nakagastos na rin naman kami ng medyo malaking halaga para dito.. The problem is, maraming defects ang bahay (e.g. GROUNDED ELECTRICAL LINES that makes us consume 4000 of monthly bill sa meralco; LEAKAGE on different parts of the house lalo na sa may lababo.)Nakailang complaints na kami sa office ng developer pero d nila kami in- e- entertain kase wala na raw warranty yung bahay and at the same time eh naka sign yung first owner na in good condition yung property nung in- accept nila..

We signed a DEED OF ASSIGNMENT done and notarized by a lawyer para sa property since wala pa rin sa pangalan ng first owner ang bahay..

Just last september poh, we have decided na i give up na ang bahay dahil sa mga problema na nabanggit at dahil na rin sa di inaaasahang financial problems. So we talked to the first owner and diniscuss ko naman lahat sa kanila yung problem / issue.. But then di sila pumayag..

Until now, andito paren kami at medu malaki na ang arrears sa pag ibig ng property by the first owner's name at palagi niya ako tinatakot sa text na kapag na elit ung bahay eh mas malaki problema ang pag uusapan nmin which is alam ko nga na ag tinutukoy niya eh yung DEED OF ASSIGNMENT na pinirmahan namin..

May nakausap ako sa PAG IBIG office at sinabi nila doon na null and void daw yung DOA dahil di pa naman ako PAG IBIG member..

Atty., anu poh kaya magandang gawin sa problema na ito..?

Nakarecieve poh ng text yung first owner ng house na foreclosure na daw yung property.. Hanggang feb 26 nalang daw poh palugit na bnbgay nila para bayaran yung arrears.. Kahit daw kalahati para ma update ung sa PAG IBIG..

Atty., anu poh kaya pede nming gawin para mapigilan yung foreclosure? Panu poh kung d kami makaalis sa feb 26?

They sold you the wrong Parcel of Land. That argument alone will be a strong argument.

Keep the Old Area Map (If there is any) that they gave to you or Geodetic Map or similar Area Chart; recover all Paperwork in relation to this transaction.

The impression is that, the Transaction between you and the First Owner is in Bad Faith; Thus, the Pagibig Fund tells you that it is in its very essence... questionable.

You are not a Pagibig Fund member, this is a matter of technical in nature.

Get a Lawyer for this.

Sir,

Need po namin ng advise regarding sa foreclosed properties na hinulugan namin ng sister ko sa PhilMay Bank (formerly Republic Planters Bank). May lis pendens pala ung mother title since 1997 (Biyaya corporation versur Republic of the Philippines) at may nagfile ng hold para ma-transfer ung title ng property from banks name to my sister's name.
Ang property po ay situated sa Maligaya, Camarin Caloocan.
Nag follow po kami sa banko pero mabagal po ung respond nila at since 2012 ay wala pa ring nangyayari.
Ano pa ba ang dapat gawin? Need po namin ng Lawyer to advise us.
