hi just seeking for legal advice

i am a manager from my previous work. i resigned last November 2012, but i did not render the 30 days notice before resignation. my last pay is on hold together with my 13th month pay. last january 2013, i called my previous employer to follow up my last pay and 13th month pay, they said that my last pay is still on process because i have an additional charges to deduct from my last pay. masyado pong malaki para sa akin ung dinededuct nila. 4,700 po for the items na hindi ko nmn po alam kung paano po sila nagcome up sa ganun kalaking charges. i dont know if nag audit pu ba sila or what. bsta nlng po sila ng labas ng mga list ng mga charges sa akin. i wasn't able to check yung items because resigned na nga po ako.

my question is:
can a company do yung ganung paraan ng pagdeduct sa mga empleyado.?

pwede ko po ba itong icontest sa kanila.?ano po bang dapat gawin..?ano2 po ba ang mga dapat na makuha ko sa employer ko pag ganitong sitwasyon po.?

ofcourse you can contest it, ask for a breakdown of those deductions.. bakit ka naman papayag na ideduct sayo kung hindi naman dapat..

alamin mo muna kung ano yung mga deductions na yun.. baka naman may naiwan ka naman talagang babayaran like loan? insurance premium? etc.

I requested the list nung mga idededuct po sakin sa HR Dpt., nakita ko po na mga stocks po sya ng branch tpos amount lang po. so i asked kung anong reason bakit icha2ge po siya sakin wala nmn po silang maibigay na reason ang HR. I asked po yung gumawa ng report ang sabi po nya mga items daw po na near expiry, items na hindi tinanggap ng office because of damaged boxes, and mga missing. Which i doubt nmn po because bago po ako umalis ng company ay maayos ko po itong iniwan. nagkaroon nmn po nang audit few weeks bago po ako magresign and hindi nmn po umabot ng ganun kalaki ang charges namin.i asked for the detailed report in which item ang missing near expiry etc. pero wala din po maibigay sa akin.

kung sakali png maibigay sakin ang breakdown at kasali po ung worth 4,700 na mga items na un ano po ang magandang action na gawin.?

saka what if po i-insist nila ung charges.?lets say sabihin po nila na yun talga ung nakitang charges sa brach na hinawakan ko.?concern ko po kasi is hindi ko na po magagawang idouble check ung mga items na un.??

then send them a letter, tell them that you made sure everything was ok before you left the company.. ask for a re audit and demand to see for yourself those items in question.
