Good day!

Yung dad ko po nag ask sa akin if ano po nag gagawin sa situation na ito.

May bibilhin po sana siyang lupa, kaso may mga squatters po..ano po ang procedure para sa kanila?court ba ang magpapaalis or kailangan pa sila macompensate?thanks po

Better move is to find another property. sakit sa ulo lang yan. it takes YEARS para mapa alis yan sila,or matapos ang kaso, likewise, kayo pa ang magka problema kung saan mo sila(squatters) i relocate.

Procedure, ang court ang magpaalis through sheriff, no compensation needed, only relocation. kayo maghanap saan nyo i relocate yan sila(Informal settlers), by the way, yan na tawag sa kanila sa ngayon.

2. Is the squatters permitted by the owner to construct their houses thereon?

thanks po sa comments, di ko po alam masyado yung details nun.

eto naman po.

may nabili kaming lupa mula sa bangko tapos foreclosed un. ung may ari ng lupa may care taker dun sa lupa pero di umaalis kahit na may pumunta nang sheriff.

best way to do it, ask the seller that as one of the conditions for the sale to push through, is for him to remove the informal settlers first. in this case, the burden is shifted to the seller and just wait for him to do his end of the bargain before closing the deal with him

One of the sources of obligation is from CONTRACT. In the contract of sale, the VENDEE/buyer is obliges to pay the total consideration in money or its equivalent, while the VENDOR has the obligation to deliver a thing or object subject of the transaction. And therefore, it is the duty of the VENDOR to deliver the property to the VENDEE free from any liens, encumbrances and squatters/detainees, unless there is a stipulation to the contrary that the VENDEE will assume all responsibility for the removal of said squatters. Obligation derives from law is not presumed, and therefore, in the absence of the terms regarding the same, the VENDOR has the obligation to do so.

In the event the alleged caretaker refuses to vacate the premises within a period demanded therefor, the VENDOR may file an action for UNLAWFUL DETAINER in the Municipal Trial Court wherein said property is situated.
