Money Problem Involving Huge Amount

good day po mga sir, my family is having a problem right now, yung cousin namin na waldas niya po ang pera ng mama niya na worth 300k pesos..yung mama niya kasi nasa US nag migrate, na iwan po sa lola namin at sa kanya yung responsibility ng bahay, but yung finances nasa lola talaga namin na entrust yun...kaya lang yung ginawa ng cousin ko is na deceit niya ang lola namin to have access sa funds kaya po nakuha niya ng paunti unti until na ubos na po yung funds...although hindi naman po siya nagtago hinarap naman po niya sa family yung kasalanan niya and nag promise naman siya babayaran niya yung 300k pesos na na waldas niya...yung agreement nila ng tita ko ay magbabayad yung cousin namin ng 10000 pesos per month, nagka pag bayad naman po siya nung first month, which is october, kaya lng nung november at ngayon december so far hindi pa siya naka pag bigay...kaya ang tita namin siyempre nagagalit na po, and yung iba naming relatives nakiki-alam na sa problema by advising my tita to send my cousin to jail...just last weekend yung tito namin na lawyer naka usap ng lola at kinausap nila yung cousin ko na to pay this coming dec 13, otherwise he will be sent to jail daw if hindi maka pag bayad ng 10000 pesos...i just want to know if pwede po ba siyang e jail dahil hindi siya maka pag bayad? kasi sincere naman po yung cousin namin kaya lang gipit lng talaga siya sa trabaho ngayon or lets just say parang wala siya trabaho ngayon but we can see that he is trying...pero siyempre problema nila yun..yung sa amin lang we want to help our cousin somehow para at least makapag trabaho siya ng maayos...mga sirs pwede niya ba ako matulongan with regards sa problema na ganito...kasi naawa lang talaga kami sa cousin namin, pero yung mga relatives namin galit na galit sa kanya...syempre niloko niya lola namin at yung mama niya..kaya para hindi din sila nag dadalawang isip na ipakulong cya...hope to hear from you mga sir. thank you po.

"Art. 332. Persons exempt from criminal liability. — No criminal, but only civil liability, shall result from the commission of the crime of theft, swindling or malicious mischief committed or caused mutually by the following persons:

1. Spouses, ascendants and descendants, or relatives by affinity in the same line.

2. The widowed spouse with respect to the property which belonged to the deceased spouse before the same shall have passed into the possession of another; and

3. Brothers and sisters and brothers-in-law and sisters-in-law, if living together."
