Arresto Menor

gud day po.. tatanung ko lng po. im raf 24yrs old. tatanung ko lng po kasi nademanda po ako for bp22. recntly lng po pinadalahan ako ng letter for galing sa court na demanda ako ng tito ng asawa ko dahil tumalbog ung checke na binigay ko sa kanya. ganito po kasi un nagnenegosyo po ako buy nd sell ng kotse. tapos ung mga checke na ibinabayad po sakin eh paparediscount ko sa tito ng asawa ko. eh 2years ko na din po sya ka transaction ng bigla tumalbog po ung checke na pinarediscount ko amounting to 120thounsand. nakiusap po ako sakanya at hingan ako ng checke ko with same amount. sinabi ko po na wala pa ko ipambabayad dahil pinapaikot ko lng po ung pera. tapos bigla nya po pinasok. at naclose ung acct. before that po eh tnxt ko na cya na wag nya po papasok dahil walng pondo at huhulogan ko nalng po sa kanya. nagdedeposito naman po ako sa acct nya pakounti kounti naka 12thousand napo ako sa kanya nadeposito.may narecieved din po ako demand letter. ng big la eh may dumating nga po letter form the court na bp22 na sya ang complainant after onewik po may dumating ulit na letter na nakalagay order. pinapagsubmit po ako ng counter affidavit within 10 days upon reciept. tanung ko lng po anu po ung counter affidavit at pwede ba po ako lng gumawa nun at anu po lalagay ko? dahil wala po ako pera para makakuha ng atty. slamat po sa mga sasagot. hope matulungan nyo po ako..

if you are not the one who issued the check, then it is required that they prove that you had knowledge that the check was insufficiently funded at the time you endorsed the check.

An endorser who passes a bad check may be held liable under BP 22, even though the presumption of knowledge does not apply to him, if there is evidence that at the time of endorsement, he was aware of the insufficiency of funds.

i recommend you find a way to get a lawyer. you prepare your own counter affidavit at your own peril.
