Hi po,

Let me describe my situation first:

1. My contract is until Nov. 17, 2012.
2. There was an issue before na nagAWOL ako for a while. Nakareceive ako ng Back to Work Order. My employer almost wanted to terminate me and let me pay the damages but he gave me a second chance. But the condition was that I'll start over that as if my contract won't end on Nov. 17. But there was no paper signed, just verbal communications.

Questions:
1. Can I resign from the company?
2. Will it be against the contract?
3. Should I still issue a resignation letter 30 days before?

Though, I'm not sure, I think my employer let my father sign a contract. Can he do that? Can my father sign another contract in my stead without me even knowing? Also, since you said my services ends on Nov. 17, should I still give a resignation 30 days prior or can I just walk out and leave after Nov. 17?

atty advice lang po sana

nagreklamo po sakin ung friend ko unjust vexation, bale my arraignment na po kami sa dec. 03 sa MTC.
pero nagkaayos na po kami nagkaroon na po kami ng kasunduan at magpapasa na sya ng Affidavit of Desistance.

ang plano po sana namin sasamahan ko po sya magapasa ng desistance sa nov. 29 at ang gusto nya hindi na sya pupunta sa dec. 03 at sa mga susunod na hearing kung meron pa man.
ano po ba ang pinakamagandang gawin?

1. kung magpapasa po kami sa nov. 29 ng desistance at hindi na sya pupunta sa dec. 03 ano po ang mangyayari?
2. kung sa dec. 03 po sya magpapasa ng desistance?

My employer called for my father to talk to him. My employer said he wanted to talk to my father before he can give me a second chance to assure himself that it will not happen again.

yurai, if you want to end your employment, you don't have to make any resignation and just allow it to lapse, but you might be liable for damages for going awol. your father's act does not bind you, but you should inform your employer.
