Hi,


Nag wowork po kasi ako sa Call Center and ung account na hawak namin is nag bawas ng tao dahil meron na clang ibang outsource na mag hahandle din ng account. My question is pwede ba kaming tangalin sa account without prior notice like 30 days or something? Ang nangyari kasi samin is after ng shift namin, dun cnbi na wla na kming trabaho kinabukasan. For what we know may nabangit nila na alam na nila na mag tatangal ng mga tao bago pa nila sabihin samin. Is it okay ba na gawin nila un?

Another question po since floating status kami ngaun, may chance po ba na mag pa retrench nlng kami? sabi kasi nila na ang floating status is within 6 months, so malapit na ang holiday season and we can't afford na mag antay kung magkakaron ng bagong account or what. Pwede din ba mag file ng petition for retrenchment? or kung meron bang ganung rights ang mga empleyado

Hello,
I am not a lawyer nor a law student but from what I know, the company should have advised you 30 days prior if it is a redundancy or retrenchment. Since you mentioned that ure now in a floating status, I assume that ure contract is not project based or coterminus to the account. Not sure of the labor law but according to one of my friends (BPO HR Manager) the company is obliged to reassign u within 30 days from ur floating status as they will be obliged to pay ur salary after 30 days even if you are not physically working in the company. Hence, if they still cannot find another designation for you they can just opt out for a redundancy. Hope this info somehow helps.

di rin ako lawyer, pero hindi naman kayo ni terminate.. you were put on a floating status... and yes, I think they can do that for a maximum of 6 months.. after which, they either give you work or retrenched you..

xtian, there were no other positions in the company that you were qualified for, then the company can validly suspend the employment for 6 months.
