annulment help and advice please

hi atty. hiwalay po ako sa asawa ko 4 years na,hiniwalayan ko cia kc nung nagaway kmi dhil sa selos nia eh binugbog nia ako ng halos hindi n ako makilala,nagfile po ako ng reklamo sa pulis pero hindi ko naman tinuloy ang kso dhil ayoko naman mkulong cia pra sa mga anak nmin.after that 4 years hanggang ngaun wla suporta o hindi man lng ngppkita sa 2 nia anak.balita ko meron n cia kinakasama ngaun at meron n clang anak.gusto ko na po maanull ang kasal nmin sa civil ano po ba ang pwede ko gwin gayon malaki daw magagastos sa annulment at pwede na po ba grounds ung pambubugb0g nia sa kin at halos abandonment sa suportA sa knyang mga anak at may kinasama na cyang iba at may anak pa..sana po ay matulungan nio akong malinawan.

binugbog ka 4 yrs ago...
nakipg hiwalay ka sa kanya 4 yrs ago..
inurong mo demanda 4 yrs ago..

sa 4 yrs na yun bakit ngaun mo lng naisipan na mag demanda about economic abuse or physical abuse??

oh baka naman may maganda na trabaho asawa mo kaya mo naisipan na mag demanda gayong 4 yrs na pala kayo hiwalay.

sa 4 yrs na hiwalay na kayo ng asawa mo anu gusto mo gawin ng asawa mo habang hiwalay na kayo mag mukmok at damdamin ang pghihiwalay ninyo?

hiwalay na kmi 4 years ago..hindi ako nagdemanda about sa pambubugbog dahil kinausap ako ng nanay ko ng hwag na lang daw para sa mga anak nmin.
ngaun ko lang naisipan dhil tpos na tlga lahat sa amin at gusto ko na rin magkaron ng sarili ko pamilya..isa pa mahal daw ang annulment kaya nga nagttnong ako dhil if mahal nga hindi ko kaya ang budget at un ang naging hadlang sa pagfile ko ng annulment.
sa totoo lang kung ano cia noon ganon pa rin cia ngaun at wlang pagbabago at ni singkong duleng ay hindi man lang makapagbigay ng sustento sa anak nia.
sa 4 years nmin hiwalay plagi pumasok sa isip ko na makipag annull na ng parehas na kaming malaya at magkaron ng mas maayos at tahimik na buhay..

if sa PAO po ako magfile ng annulment case malaki pa rin po ba ang magagasto sabi po nila wla daw po babayaran dun...totoo po ba???Hindi nman po me nagmmdali sa annulment process ang hinahanap ko lang po less expenses dahil wla po ako budget.. saan ba mapupunta ang 150k-250k na bayad na sinasabi???

@3rdgen sa mga impormasyon na ibinagy mo, hindi pa sapat iyon para maanull ang kasal mo sa asawa mo. Pero yang 150-250k bayad yan sa lawyer. Yan ang rate ng mga private practicing lawyer. ANg pambubugbog kasi ay hindi batayan upang mapahintulutang maanull ang inyong kasal, pero syempre ang korte ay nagdedesisyon in a case to case basis.

I suggest na kung support talaga ang main intention mo ay go push through a p petition for legal separation, included na support, custody, property regime or relation. Pero hindi parin kayo maaring makapag asawa. Kung gusto mo namang mag asawa ng iba, annulment lang talaga ang remedy.

1) Undue influence or intimidation

2) Minority

It would take 1-2 years. 150-250k..

The Family Code took effect on August 4, 1988 which amended the above-stated provision adjusting the marrying age to 18.

Hi,Good day, ano ba ang dapat kong gawin kung ang grounds ay undue influence or intimidation at minority? anong documents ang dapat kong ihanda? i was 15years old and was forced to marry the person i do not like..He was 26years old at that time, marriage happened in the year 1985.. pls give me more advice on what to do? need ko pa rin bang ayusin sa korte un? thanks, hope anyone can reply and give me advice with my problem...

meron bang ganyan law na kahit menor de edad ay valid ang kasal????

OFW po ko may nkausap ko na lawyer 180k ang grounds is psycological incapacity include n daw sa psychologist.payable in 10 months ganito ba tlga ang mga price?

Tska pag sinabi ho ba na 1 year, from the date po ba un ng filing ng annulment case or from the date ng hearing? baka po may makasagot pls.?tnhks & more power!

i think 180thou is the "prevailing price" sa mga annulment cases now..

Thanks, how about if they will say 2 years to grant the annulment, san po ang start upon filling in court or after hearing po ba? tska may limit po ba ang pagfile?

Authenticated from NSO of Marriage Certificate & birth of the children po ang requirements,yong sa grounds kadalasan po na nkausap ko na lawyer is psychological incapacity ang ginagamit dadaan daw po sa sa examine ng psycologist pero kasma na sa package deal yon..Based lang po to sa mga nkausap ko po to bec i hav already a contract for annulment.sana po magka idea or makatulong po to salamat

Mine is very much complicated. We have been together for 8 years now (with 2 children) and just got married last Feb 2012. After our marriage, some time in March 2012, he admitted that he is not using his real name and that he is previously married. (He is not the person I have known after all) I was totally betrayed and fooled. I accepted it mainly because things are not sinking in well. I have been getting lies from him every now and then. Bottomline, i totally lost my trust for him and slowly my love for him. Please help! I want an annulment and be totally separated from him. I don't want to spend anything since i am innocent and not at fault here. What will I do? Please help!

@wilma ung lawyer mo na ang bahala sa papers, he will find all solution based on the facts of your case to prove psychological incapacity or either yung grounds for voidable marriage. as what hlslawph said di ko nacompute kung kelan ba nacelebrateyung marriage. Family Code took effect August 3, 1988.. JUst check. kung before pa yung marriage mo nyan the New Civil COde will govern therefore the marrying age is 14 and 16 for women and men. Nevertheless, voidable yung marriage mo kasi you consent was vitiated during the marriage.

@mariolle First, your marriage is bigamous, Second, he used a different name, there is mitake to the identity of your husband.Therefore, your marriage is void for the beginning.

As ko lng kung after ba ng annulment dinidiscuss din ba ung mga conjugal properties?kc halimbawa magrant po ang annulment ko, mahahabol ko pa ba yong benenta nyang mga properties na wla ko consent dahil nsa abroad ko? salamat po!
