Arresto Menor

An account has been made by someone I know, and pretending that account is under my name. Uploading pics with scandalous and harassing captions for my 8month old daughter. Would that be useful in the court? But the account is under my name.. But it's not me who made it.

If properly documented, yes it can be used. But your biggest problem is to show and prove who’s the real owner of that account.

Report the malicious account to FB so that they can make some action. Also set your account to strict privacy. And remove any tag.

If you really knew the person who created that fake account, make sure you have enough proofs. As far as I know of, Cybercrime law is effective starting Oct3, 2012.
