Arresto Menor

I was misunderstood by my officemate. Out of her anger, she shouted at me and accused me of many things. I tried to explain but she kept on raising her voice. She wouldn't listen to my explanation. I was publicly humiliated. Her accusations were not true. Can this be a ground for oral defamation?

yes. if you are determined enough, then file a complaint. if you both reside in the same city or municipality, it has to go through the barangay first. If not, you can file a complaint-affidavit at the prosecutor's office in the place where it occurred. better if you can get witnesses who saw it happen. you have to be able to quote exactly what she said.

Art. 358. Slander. — Oral defamation shall be punished by arresto mayor in its maximum period to prision correccional in its minimum period if it is of a serious and insulting nature; otherwise the penalty shall be arresto menor or a fine not exceeding 200 pesos.
