somebody is posting nasty things about me on Facebook. she bluntly posted my name and use profane words. Aside form that she also discriminately described me in words that are intended to dehumane me. Im planning to file a case against her. She also dared me to go ahead and file the case in court and it wouldn't stop her from telling those things against me. I already have a witness that can prove that she's using that facebook account for her personal and public communication. But what are the other evidences that i need to present?

i am currently defending someone who is accused of e-libel on a social networking site. your lawyer has to be knowledgeable in libel and electronic evidence.

the rules are here: http://sc.judiciary.gov.ph/rulesofcourt/2001/electronicevidence.htm#rule1

using your browser, save all the webpages where the defamatory remarks are made along with the profile pages. you will have to allege and prove the requirements of the rules as best your can.

and this is not oral defamation, it is written and published, hence libel.

can i use screenshots as evidences? what if the person also texted me and used profane words as well?

screenshots are the best, but try saving the page as well to capture the whole thing.

text messages can also be used as evidence if you can prove who the sender is. you can show the malicious intent and develop another charge of unjust vexation.

is there a specific time frame that the case should be filed? and can i send you the screenshots for you to check if those are enough for me to file libel against that person?
