Dear Atty's,

How defend Illegal Parking vs. Prohibited Parking?

In the Barangay Ordinance "Prohibited Parking" has no fine, so instead the violation cited by the traffic enforcer was Illegal Parking.

Now the traffic violator's defense is that why has he been cited for illegal parking when in the Barangay ordinance states Prohibited Parking which has no fine?

How will you defend this case if your the traffic enforcer or the lawyer? against a person who has also knowledge regarding the ordinance?

Illegal parking is the biggest problems in some mega cities, If someone is not following it there should be a strict laws.

What is prohibited is illegal. Therefore the contention of the traffic enforcer is correct. He who raises illegality must not rely on the weakness of a party but on the strength of his defence. Clearly there is an ordinance violated, malay ba ng traffic enforcer ang mga batas ng barangay. Lahat ng mga traffic enforcer ang alam nila mga ordinances.
