Is there a KIND of ruling or decision like this; This is ridiculous and annoying.

The Court's Ruling

The petition is partly meritorious. Question

and for so many years I am fighting with my rights. Company is compensating me this amount. Evil or Very Mad

"WHEREFORE, the foregoing considered, the assailed
Resolutions are MODIFIED in that private respondent is ordered to pay petitioner the amount of P30,000.00 as nominal damages for
non-compliance with statutory due process.
SO ORDERED.

WHERE IS THE JUSTICE THERE??

Question: Can this case be reopened? The company did not give the money anyways !!!

Pano naman yung almost 4 years na ipinaglaban ko yung kaso, mga gastos sa abogado. Nagutom rin naman ang pamilya ko?
Please advice, gusto ko naman sana "just compensation" Earned leaves ko diko ba pwede makuha? 12 years din kaya yon.

eh sana sinama mo yun sa prayer mo bago mo sinampa yung kaso.. yung earned leaves kung may company policy na pwedeng i convert sa cash.. dapat kasama sa last pay mo yan..

Isinama naman po lahat. Doon nga po ako nadismaya sa "The petition is partly meritorious." Tapos sa 30,000 lang for almost 4 years na mabagal umusad ang kaso. Asan po yung fairness doon?

Pwede po ba mabago pa ang decision?

May policy naman po na ganon yung company. Pero wala naman po sila binigay sa last payslip ko. Discriminated pa nga ako, aping api baga at for sure may mga salita pa sa likod ko.
Apektado kasi mga anak ko kaya gusto ko balikan mga yon

what it means is that the arbiter/commission/court found basis for your termination but there was no proper procedure followed.

you can appeal if you believe it is wrong

Sir attyLLL,

I want to appeal, but the question is. Will they listen or care at all. Takot na ako, as a feedback sa isang bubwit sa Supreme Court, nabayaran ang kaso, para di naman mahalata, they made this decision. Pader ang binangga ko and I don't have the funds para lumaban. Makatagpo pa kaya ako ng tapat sa tungkulin at marunong kumilala ng tama at mali? I am still open for advices... I hope matulungan mo ako...

di lang po nakakadismaya. nakakapanghina at nawawalan ako ng tiwala sa hustisya natin. Totoo atang ang kasabihan ang "hustisya para lang sa mayayaman o may pera lang". Napakaganda ng Pilipinas para tirhan, sana naman dito man lang sa hustisya maging bantog tayo sa pagiging patas.

Wala na po ba pwede magadvice? I guess charge to experience na lang. May God Bless this ill fated judges who made this decision. I still believe someday their foolishness will go back to their bodies. may mga judge pa ring tapat pero mabibilang mo lang sa daliri.

----true. The Agabon doctrine enunciates the rule that if the dismissal was for just cause but procedural due process was not observed, the dismissal should be upheld. Where the dismissal is for just cause, as in the instant case, the lack of statutory due process should not nullify the dismissal or render it illegal or ineffectual. However, the employer should indemnify the employee for the violation of his right to procedural due process. The indemnity to be imposed should be stiffer to discourage the abhorrent practice of "dismiss now, pay later," ruling. In Agabon ruling the nominal damages awarded was P30,000.00..

Goodluck... I just hope you hold no grudges against judges/labour arbiters.

Thank you for the advice and it is really another reason for me to believe may chance pa kaya?

Ibig sabihin po ba just cause ang dismissal ko? But the stories they made are all untrue, I find it personal from my Territory Manager when this case is filed. Yun ang ipinaglaban ko, he manipulated other people to make stories para madiin ako and promised them even positions, in which ng maalis ako nakuha nga nila ang positions na ipinangako. Nababayaran ang batas natin. I truly believe kaya ako natalo dahil wala akong naibigay ng may humihingi sa akin.
Honestly Sir, nagtanim ako ng sama ng loob and talagang tinandaan ko ang mga names ng mga judges/arbiter and colleagues na sumira ng buhay ko. Gusto kong lumaban pa rin ng parehas, pero dehado ang mahirap palagi.

As you have said, The Agabon doctrine is just a basis for the dismissal. That year, ang halaga ng pera ay mataas na. But for my case, yes I lost but it doesn't mean na dapat ang ibayad lang sa akin ay PHP 30,000.00.

Siguro matatanggap ko pa kung at least "just compensation naman ang binigay na desisyon. Asan ang earned leaves ko, sa akin yon at pinaghirapan ko.

May chance pa ba ang motion/appeal with this kind of scenario na pwedeng tapatan ng pera ang batas?

I do appreciate Sir ang payo pero may reservations pa rin po ako. Nadurog na ako noon at hanggang ngayon napapanaginipan ko pa ang hirap na dinanas ng pamilya ko.

Dapat pa ba akong maniwala sa justice system natin?

if this was a decision of the arbiter or commission, you only have 10 days from receipt of the decision to file an appeal or Motion for Reconsideration.

if this was a decision of the commission on a motion for reconsideration, then you have 60 days to file a petition

from the point of view of the courts, it is evidence that is important.
