Hello,

I would like to ask an advise.
Someone issued postdated
checks to me, total of 9. All
of the checques were bounced I
I went to our Brgy. to asked
help but this person refused to attend
to attend hearings and sent
letter that they will just
see us in court not to mention
that I am not the only 1 complaining
we are 3 and the rest not yet
filed case. My question are...
1. Makukulong ba itong tao na
kapag nagfile ako ng criminal
case BP 22.
2. Billable ba itong batas na ito?
3. Usually ilang taon ang
imprisonment nito.

bp22 is bailable. the Supreme court has issued a directive that if a fine will suffice for a conviction of violation of bp 22, then that is better than imprisonment.

if the person has properties, then I'd prefer a civil case so that you can request court for preliminary garnishment of the properties. if none, then a criminal case will be better.

Hi, AttyLLL!

Thank you very much for the quick response. I have a follow up question po. Actually naaasar na po talaga ako dito sa mag-asawa na ito kaya gusto ko makulong na lang sila kasya marami pang mabiktima. Kasi last week may nabigtima na naman sila.

1. Ano po ba ang kaso na puede naming isampa sa kanila para makulong. 3 po kaming niloko nila at marami pa pong iba pero umaasa pa rin sila na babayaran sila kaya hindi pa nagfile ng complain. At bukas last na po ung hearing namin sa Lupon.

2. Kapag nagfile po ako ng civil case mababawi ko po ba ung 100,000 ko tapos ung pangbayad ko sa abogado at extra expenses ko like transportation mababawi ko po ba? As in one time big time ba nila itong ibibigay sa akin?

3. If ever po kailan ko mababawi ito?

4. Puede po ba na 2 ang file ko na case criminal and civil.

Hi, Atty.!

Atty.! would like to ask po what is the legal way of anotation. Nakamortgage yung property sa amin ng friend ko kaya lang sya nakapaganotate sya kasi nakalagay yung TCT# sa contract nila while ako hindi so hindi ako pinayagan ng Registry of Deeds so we are confident na hindi mabebenta yung property nung tao hanggat hindi kami nababayaran. Now we are so surprised that last friday ng nagrequest yung friend ko sa registry of deeds ay nabenta na yung property. Now this is my question.

1. Puede ba na dayain yung anotation?
- Ng magpaanotate yung friend ko sya yung first na nagpaanotate (Sept. 2010). Tapos nung nakita namin nacancel yung anotation kasi nakamortgage daw sa isa pang tao nung 2008 pa pero wala naman sya anotation. Nagpaanotate lang sya Feb 2011 tapos binili nya ng March 2011.
2. Ano po ba ang dapat gawin since we are very much confused kung bakit nanyari yun?
3. Mahahabol po ba namin yun property kapag dummy yung bumili?

sorry, i am also confused on what is annotated and what is not annotated on the title.

nevertheless, an annotation of mortgage does not prevent the owner from selling the property. the new owner acquires the property subject to the previous mortgage.

Hi, Atty.!

1. Question lang po kung gaano katagal ang decision ng Fiscal sa mga cases. Sa Makati po ako nagfile last meeting po ay March 24, 2011 ng magbigay ng rejoiner yung denemanda ko po so usually mga ilang months po lalabas yung decision ng fiscal. Medyo nawawalan na ako ng pag-asa na makuha ko pa yung pera ko kasi naibenta na yung bahay at lupa nila Sad
2. Next question po kapag ang desisyon ng fiscal na bayaran lahat yung bounched check nya sa akin tapos wala na sya sa lugar namin pano ko po sya mahahabol?

1-3 months is not uncommon. keep following up.

the fiscal will only decide whether there is basis to charge bp22 and then file it in the court. if he does not appear at the hearing, a warrant of arrest will be issued.
