Pls. I need help po... i just want to ask kung anu po ba talaga ibig sabihin ng oral defamation? at kilan ka pwedi mag file ng oral defamation sa isang tao? kasi po they filed me oral defamation in our baranggay than to think xa pa ang may kasalanan sa akin kasi di na nya binalik yung pera ko. pls pls pls po help me. im waiting for your advice. thank you po.

in non-legal terms, slander is making oral defamatory statements against someone and it is heard by other persons.

the barangay cannot decide if you guilty, it can only try to get the parties to settle. but if it fails, the case can be filed at the prosecutor's office.

Tama po ba ginawa nla? pwedi po ba ma invalid ang reklamo nla kung sa brgy pa po ang hearing?

at panu ko po malalaman na genuine yung SPA nila na pinakita kasi po walang witness na nka perma peru may notario naman at photocopy lang na SPA ang nka attached sa sumon... kasi po yung sister A ay binigyan si sister B ng SPA xa ang humarap sa pagkaso sa akin... pwedi po ba yun?

a text message cannot be basis for oral defamation. unfortunately, it can be basis for a charge of libel because the defamatory remark was made in writing. it is considered evidence and may be presented by either the sender or the recepient of the message.

i would not recommend that you try to prevent their complaint at the barangay by questioning their SPA.

could you please tell in more detail what happened. who were you texting with? what did you say? who was referred to in your text?

If you texted to A that B is a criminal, it may be considered libel because the principle is that as long as a third person saw it, that is considered publication.

If you texted to A that A is a criminal, then it may be considered unjust vexation.

the barangay is not a good place to question the personality of the representative of the complainant. any person can report a crime except in cases of private crimes like adultery, seduction and concubinage.

i suggest you just attend the lupon conferences. if you don't want to settle, then their next step will be to file a complaint with the prosecutor. you can't do anything to stop that because it's their prerogative.

" sa txt ko po nasabi yan, ngayun po kakasohan nya ako ng Oral defamation. since kinuha nya sa bahay ko ang mga RTW ay hindi ko na po xa nakita tru txt lang po communication namin. yun po ba mga txt ko na yun pwedi na nya ako makasohan? anu po ba laban ko sa kanya?

Good morning po Atty. LLL. i am seeking some advise with regards po sa oral defamation.. I am having a good business which is in the wedding industry.. i have received a summon last monday.. kasi po yong competitor ko po nagpatawag sa akin sa barangay because of what he heard daw na sinabi sa kanyang customer na they have a bad services po.. and he present some names na nagsabi po daw na sinisiraan ko po yung business nya.. the fact po na hindi ko pa nakita ang office or shop and then yong mga customer niya naging customer ko din na hindi nasatisfied sa kanilang services... tanong ko po.. ano po ang laban ko sa kanila?? sa oral defamation po ano po ang basihan na nila and ano po ang paglaban ko sa kanila... hope and pray that your word of wisdom will ease my thinking..

barangay is for settlement. the barangay cannot decide whether you are guilty or not.

for a case of oral defamation to prosper, the person who heard you say the defamatory remarks has to be presented. the defamed person, if he was not there when the remarks were made, does not have personal knowledge and his statements are mere hearsay.

atty lll, thank you for the respond, then ito po if the witness were presented, pwede po ba akong magtanong sa kanya to prove it what s/he heard of the defamed remarks.., does it mean na they have a strong case against me kasi may witness cya? tapos po, when we have a conversation sa phone he threaten me if magkita kami may masamang mangyari sa akin.. can i file a case against him? paano ko cya idiin na he threaten me..

the person who heard you can testify or issue an affidavit that you said the defamatory remarks.

masamang mangyari sa iyo is considered unjust vexation. if you want to file a counter charge, file it now also at the barangay.

if you live in the same municipality or city, you should have filed your complaints at the barangay. if no settlement is reached, the bgy will issue a certificate to allow you to file your complaints at the prosecutor's office.

if you have witnesses, then it will be good if you can draft their affidavits now and have them notarized before they start forgetting the details. It is even better if you can retain a lawyer to assist you.

Nasa prosecutor's office na po yung kaso ng oral defamation, slight physical injury at threat. Yes, di po kami nagkasundo sa meeting namin sa baranggay office about sa kaso namin sa lupa. At yun po yung time (sa meeting sa baranggay) na inuntog nya po ang ulo ko sa grills kaharap ang mga baranggay officials at mga kasama namin sa meeting. Galit na galit po sya that time at natapos ang meeting sa hindi pagkaka sundo. Nung gabing yun din nya po ako sinugod sa bahay at halos gibain ang aking pintuan dahil pilit nya akong pinapalabas ng bahay at papatayin at sasaksakin nya daw ako.

Malakas po kasi sa baranggay yung kalaban ko kaya isinampa ko na ang kaso. Gusto ko lang po ng linaw kung ano ang mga dapat kong gawin. Ang mga isinumite nya pong counter affidavit ay pawang puro kasinungalingan. Ang maganda lang po ay marami ang naka saksi sa mga ginawa nya nung araw na yun laban sa akin.

Nangangamba din po ako sa kasasapitan ng kasong ito. May anak din po kasi syang sundalo at pinag bantaan nya po ang aking buhay.

do you mean you did not file your own complaint at the barangay and filed it directly with the prosecutor's office without a certificate to file action from the bgy? if so, your cases may be dismissed.

it doesn't matter if "malakas siya sa bgy". you still need the certificate and you are entitled to one if you don't reach a settlement over your complaint.

Yep, filed the complaint at at bry office, and still, hindi po yun na settle. That's the reason why nai-UP na po sya sa prosecutor's office. Yes, may certificate to file action po.

I wanna know how long this case would take, and ano pa po ang mga dapat kong gawin. I also have my witnessess statements. And what posible things i can still do to make sure i can win the case.

nai-UP? did you prepare an information data sheet, complaint affidavit and witnesses' affidavits?

the case is not automatically elevated to the prosecutor's office.

resolution normally takes about 3-6 months.

1. Went to the brgy to file a complaint. They have scheduled meetings (3 time) until no settlement was met.

2. Got a certificate to file action from the barangay office, went to the police station and filed a blotter.

3. Went to the Manila City Hall, then filed the case. They have sent her a subpoena, but she did not show up.

4. 2nd time she did show up, and she have submitted counter affidavit for my complaints.

5.The fiscal asked me if i will answer the counter affidavit she have filed, and i have said i will no longer answer the said affidavit and told the fiscal that i will just submit the documents (my complaints and witnesses affidavits etc).

6. When i went home and read her counter affidavit, i have decided na sagutin yung counter affidavit na nai submit nya.

7. Nag request po ako na masagot yung counter affidavit na ipinasa nya. BTW, ang mga witnesses nya po ay ang kanyang ka live-in partner at isang taong wala naman doon sa oras ng mga pangyayari nung maganap ang kanyang pananakit sa akin.

8.Nasa fiscal's office na po yung case.
Ibinabalita po nung nireklamo ko na made dismiss daw po yung kaso, may mga instances po ba na magkaroon ng posibilidad na ma dismiss nga po yun?

it all depends on the appreciation of the prosecutor and how well you were able to present your arguments and evidence.

bali po nag aaway dahil nag fenced po siya, hindi siya ang may ari, nautusan lang daw siya. sa looban kasi kami nakatira.

nagreklamo kami sa city engineers at sa barangay... dahil nag start na siya maglagay ng bamboo na mga poste. usual passage ho namin palabas yong daan. dito palang sa reklamo namin, galit na siya kasi pinatawag siya ng city engineers office.

araw ng sunday at talagang single out kaming pinagalitan na di na pwede dumaan,, ang samin man lang kapitbahay naman kami, di pa siya nagpunta at nag inform samin na magsasara na kami di na pwede dumaan. talagang hinuli pa kami sa akto na dumaan at pinagalitan...kinuhaan pa kami ng video na nag aaway...ITONG video na to gagamitin niya na evidencia sa court.. e honor po ba ng court ito as evidence? para po kasi kami niya pinasok sa isang halwa na framed up... kinunan ng video.. para makafile siya ng oral defamation....

ano po sactions in case na matalo po kami.

nakipagaway PO kasi ung mama ko sa kapitbahay namen and during the fight our neighbor say "ang anak mo pokpok!!pwe. .! kung di ko pa alam ung mga ngpupunta jan mga pokpok!!(those are my classmates sleeping over here to do our thesis research)" then she followed up "pati anak mo kinakalakal mo!kayo na meh pok pok pwe!" oral defamation po un diba? esp. that i don't have any records with regards to that issue.I'm a SK councilor po and malaking kasiraan un skin. but the problem po is wla po kming witness ang nkarinig lang po eh mga kakampi nung other side and my papa. . ano po ba dapat gawin malapet na po kasi ung last na paghaharap sa barangay and di po namin alam kung dadalin namin un kaso sa mababang hukuman. .

well, you have three testimonies, yours, your mom's and your father's,

i believe it is oral defamation. if not then add unjust vexation. just get the bgy cert to file action and file your case at the prosecutor's office. good luck.
