ask ko lang po, gusto ko lang po sana malaman baka po meron legal grounds to file a case against a mentally ill person subject to mental evaluation and eventually hospitalization by court order? need help po. salamat po in advance.

if that person is a danger to others or himself, the legal recourse is to file a petition in court to have him committed

Hi,

I would like to know if you can file a case against your superior for the following situations:

Incident #1: Person A committed an honest error in his report. Person B (his supervisor) told him, "Ilang taon ka na ba nagtatrabaho dito? Hanggang ngayon mali-mali pa rin ginagawa mo...saksakin kita dyan ng ballpen eh!"

Incident #2: Person A has been absent for a week due to his medical condition and has informed his company's HR dept. regarding this for sick leave application purposes. During the weekly meeting, person B (supervisor) and person C (manager) made the group aware of person's A absences by making the remarks: "Wala naman atang sakit si person A eh. Ayaw lang siguro pumasok." Person A learned about this incident through his co-worker who attended the said meeting.

Please advise.

another question ko po.

what if the person is showing a little stability? and that the person has gone to CHR and complaining that his rights has been violated? that her/his neighbors are forcefully provoking him/her to act in such way that she/he would seemed like insane?

this is so confusing. i'm feeling like his/her neighbors has violated his/her human rights, but on the other hand, he/he caused so much nuisance and disturbance these past few months, and it is unfair for the neighbors who suffered from his/her actions when he/she was mentally unstable?
