i need your advice regarding debt payment

Arresto Menor

Dear Sir,


Good day to you. I completely stress out because of this recent legal
hurdle. This problem was not even mine to begin with it was my
parents. Please allow me to share the detail.

On May 2001, my parents procured a loan with the amount of 40,000
pesos from a lending company whose owner happens to be a family
friend. Anyways years has passed and that loan was not paid bu the
owner is not to keen of receiving the payment as she is a friend of my
parents and wanted them to bounce back from a financial setback.
Anyway my mother went abroad and the correspondent between her and her
friend "the owner of the money". They kept on communicating all
through the years. Last 2011, however they now put pressure on us, my
dad was summon to the Barangay captains office. They forced into
entering this very one sided agreement it was stated their that we
should pay approximately 257,000 principal amount plus an interest of
50,000 interest making a total of 277,000 payable. I was there with my
father and they even let me signed the papers telling me that I was
just a witness. I think this is unfair because the original debt was
only 40,000 pesos. My mother even said that this is like an outright
robbery. It was also stated their that we are to pay them 10,000 per
month starting that June 2011. My mother complied, then there were
months that we missed a payment and they readily summon as to the
barangay. We were able to pay them a total of 60,000 pesos. At first
we were able to attend then it became physically impossible for me to
be there because I had to go to Manila for a my review. I was my
mother's representative. As of June 2012 they serve several summons
telling as to pay 277,000 plus a legal fee of 22,000. Now why is the
price still the same when we paid them already a total of 60,000
pesos. We do not have any money to cough out what's the use meeting
them and being underestimated and insulted allover again. Now they
summon me into an official court hearing. I don't know what to do when
in the first place I was not the one who owe them money. They are
claiming that I owe them money when in fact I only signed the
agreement from the barangay captain because they told that I was only
a witness, now I am being implicated as one of the respondents. What
should I do, my parents are not here to help? and I don't have any
money or resources to pull and pay them?Plus I was deceive into
signing the papers because they told me that I was just the witness.
On the time that I signed the papers I was a fresh graduate with no
job and no capacity to pay therefore I did not have the intention pay.
What should I do next? The court told me to send my response within
ten days.

Please help me. Your advice is highly needed. Sad
