Dear Atty,

I married my gf while my 1st marriage was not annulled yet. My first wife knows I will be applying for annulment and she will just wait for the approval. I then got married to my gf so i can get her husbands visa abroad. My cousin took
care of all paperwork and we got married civil and registered at NSO.

I showed the NSO copy and authenticated and notarized and we got her husbands visa and we stayed for almost 3 years abroad.

After 9 months of being married and staying abroad ,i confessed that i have not yet annulled the first, she agreed coz she loves me to just fix it and now after 3 years , she is using it as an excuse coz she run away and staying most likely with another guy using my husbands visa also. I cancelled it and she went to another country with the guy.

I cancelled the husbands visa and my question is if she files bigamy against me , is she also guilty coz she knew about it 3 years ago,,even though we are married already and she signs her passport and visa and all papers that i am her husband.

Is our marriage valid until it is declared null and void?? lawyer said here that if its registered in NSO its valid until declared null that's why i got the husbands visa -- bigamy happened back in Phils so they do not care--

Can she remarry immediately w/o declaring null, if she marries again is that also bigamy? should i be present on declaration of nullity?

if she has sex with another guy without declaring it null yet,,is she committing adultery ?? and what proof do i need?? should i have pictures or the obvious actions of having another man enough??

pls help..really appreciate the advise

if it can be proven that she knew about the first marriage, then she is considered an accomplice in bigamy

yes, it is considered valid until declared void.

if she remarries, then it is also bigamous.

if she has sex, then it is adultery.

note that the crimes of bigamy and adultery under philippine law will apply only if committed within philippine territory.

Sir,

nalaman nya lang na d pa na annul nung after 6 months na kami kasal..inamin ko at nagsorry pero sabi nya ayusin na lang daw at after 3 yrs pa nung nagloko na sya at sumama sa iba ay yan na rasun nya na file daw sya bigamy,,..

.d nya alam nung nagpaksal kami pero alam nya na nung after 6 months then lahat visa,passport at ibang imsurance ay mag asawa kami.at lahat ng papers ay na sign nya after alam nya na about sa una--.at alam nya na d ko pa na annul yung una kasi nakulangan me pera.

pls..advise kung considered accomplice din kasi alam nya na after kasal pero sabi nya ok lang and now after 3 yrs pa sya hanap rasun kasi nakahnap ibang may mas marami pera...Sad

PROSECUTOR: Nag check ka ba sa NSO o kumuha ka ba ng CENOMAR para sa magiging asawa mo bago ka nagpakasal sa kanya?

yup and kung tinanung sya na bakit after 3 yrs ka pa sya file bigamy ,after naka sign ka na sya papers at passports, visa at sa banks at DFA,considered ba ba sya accomplice kung kahit alam nya na after kasal and pumyag sya pa rin patuloy at d nya pina annul agad??? psl advise tnx

the answer is no, she should not be convicted of bigamy, because what matters is that she positively knew you were married before your 2nd wedding.

even if it is proven that she took no steps to determine whether she knew that the groom was married, that will not be sufficient to convict her.

any person can file a bigamy case within 15 years of discovery of the 1st marriage.

one of the best defenses in bigamy is to file an annulment case of the 2nd marriage based on an essential requisite such as consent or lack of license.

sir,

nagpakasal po kami ng wife ko when she was only 16 and ako naman ay 21, nagawan po ng magulang nya ng paraan na maipakasal kami kahit menor de edad pa sya sa haus nila mismo dahil nagdadalantao na sya at ako ang ama, para masalba sila sa kahihiyan at sa mata ng tao ay nakasal kami. nagsama kami at nagakaroon ng tatlong anak, nalaman namin na di valid ang kasal namin kasi menor de edad pa sya that time. check ko sa NSO and found out naman na registered ang kasal namin, pero dahil sa gusto namin na nasa legal age sya sa kasal namin, ginawa namin ay nagpakasal ulit kami, this time ay nasa legal age na sya. instant kasal po, may naglakad sa city hall then presto pirma lang sa marriage contract ay kasal na kami. wala nag officiate, may pumirma lang na REverend ay ok na. kasal na kami. after 2 mos check ko sa NSO, registered na rin. my question is... valid po ba ang kasal namin nung 2nd time around? yung una naming kasal ay for sure ay not valid, tama po ba? i married her twice sa dalawang magkakaibang panahon at pagkakataon? macharge po ba ako ng bigamy?
ngayon po ay mag 7 years na kaming hiwalay at may kanya kanya nang buhay. lahat po ng anak namin (3 kids) ages 21, 20 at 13 na now ay sa akin na lumaki dahil iniwan nya sa akin silang tatlo.
gusto ko na po sana madeclare na invalid ang dalawang kasal namin. tell me what to do. please sir.

Sa pagkakaintindi ko sa kwento mo, ang parehong kasal ay valid, sa mata ng batas ay legal ang kasal ninyo.

Sa palagay ko, hindi ka makakasuhan ng bigamy dahil parehong babae naman ang pinakasalan mo.

Pwede mo ipadeclare void ang parehong kasal. Mag file ka ng petition for declaration of nullity of marriage.

Ako po ay ikinasal nuong April 6, 1997 dahil sa ako ay nakabuntis. Noong mga panahong iyon kaka 18 ko lng (birthdate: March 31,1979) samantalang ang aking napakasalan ay 17 palang (May 30, 1979). Inihabol na kami ay makasal upang hindi maging illegitimate ang aming anak na ipinanganak naman noong June 30, 1997 (halos 3 buwan matapos ang kasal).

Dahil sa takot na ilayo sa akin ang anak kaya naman pumayag na rin ako magpakasal. Wala ang kanyang mga magulang nuong mga panahon na iyon kaya naman ang kanyang auntie ang tumayong guardian nya. Nasa US ang nanay nya at di makauwi samantalang ang tatay nmn nya ay may iba ng pamilya. Ang di ko lng maintindihan ay kung bakit may nakalagay na "(D)" sa dulo ng pangalan ng tatay nya sa marriage contract namin dahil isang malaking kasinungalingan kung ang ibig sabihin niyon ay deceased sapagkat hanggang ngayun ay buhay ang tatay nila. Ang nanay naman nila ay nag asawa ng US citizen.

Isa pang gumugulo sa aking isipan ay kung may marriage license nga kami at kung sakaling meron ay kung paano kami nakakuha samantalang wala kami dinaluhan na kahit anong seminar sa simbahan bago ang kasal. Tanging ang auntie lamang nya ang nakakaalam at nag aayos ng lahat dahil isa syang lector-commentator sa simbahan sa aming lugar.

Ikinasal din kami sa ibang simbahan na di nasasakupan ng aming parokya (subalit nasasakupan pa rin nmn ng Diocese ng San Jose), di ko rin alam kung nakakuha ang tita nya ng permit.

Ang pinakamalaking katanungan ko po ay maari po bang gamitin na dahilan ang aming edad upang mapawalang bisa ang aming kasal dahil malinaw na dinaya ang kanyang ito sa pamamagitan ng pagpalit ng taon ng kanyang birthday na kung saan ang 1979 ay napalitan ng 1978 upang maging edad 18 sya sa araw ng kasal?

Matagal na rin kami di nagsasama matapos na magkanya kanya ng buhay makalipas ang 2 taon ng aming kasal. Sa ngayon ay may 14 years na kami di nagsasama. Sa akin lumaki ang aming 2 anak katulong ang aking mga magulang at kapatid sa paggabay sa kanila samantalang ang kanilang ina ay madalang lamang sa isang taon kung magpakita.

Mas mabilis po ba ang pagprocess nito compared sa paggamit ng Psychological Incapacity etc as ground for annulment.

So, it means grounds for nullity ang age nya?

Maari rin po ba magfile ng annulment na gagamit ng 2-3 grounds? or sa case ko enough na ang pagiging underage?

nakalimutan ko po yata banggitin na 18 ang age nya na nakalagay sa marriage certificate dahil nga ginawa nilang 1978 ang dapat sanang 1979.. kung tutuusin ay halos dalawang buwan pa para mag 18 sya nuon.

pwede po bang masabing "fraud" yun dahil ang birthdate nya sa passport at birth certificate ay 1979 at sa marriage contract naman e 1978?

If adultery can be considered automatically forgiven if you have sex with your wife after knowing of the adulterous act or wife admiited to the adultery...is it also applicable in Bigamy ??

If 2nd wife was told that marriage is bigamous and not yet annuled on the first, but still forgave the husband and have sexual intercouse for many years and just suddenly want a reason to leave,can she still file a case of bigamy since she already forgiven husband and had sexual intercourse already after knowing of said act?

how can u prove that 2nd wife knew about previous marriage?? is witness good enough coz she can just deny it right? or does she also have to prove that she did not know about it like texts,letters or witnesses also ??
