you mentioned common law, meaning not married, and the child was 5. by law, the mother has ALL the rights to the child. you cannot file a case, unmarried nga eh.

In rule with illegitimate child, the mother has full parental authority. though the father has right to visit the child/children.

You are the common law wife (to be clear).
You can file a case for Vilence against Women and Children and seek a temporary protection order to keep your ex-bf away from you and your child. Anyways, because the child is 5, under the law, the child SHOULD be with the mother.

File a Habeas Corpus case to get custody of your child. You can also file a case of RA9262 against your bf.
