withdrawal of annulment

good day! i want to know if i can withdraw my petition for Nullity of Marriage even without the consent of my lawyer. the lawyer that handles our case is on my husband's side. ung asawa ko po ang nagbabayad sa kanya. kaya po ako nag file kasi ako po talaga ang may problema sa kanya. and he wants to marry again. so we have this agreement: child support continues monthly,he gave us car to be used for fetching our kids from school. kaya lang po i found out na parang talo po ako with our properties. and last march i found out that my husband molested my 3 daughters. so i filed a case. i don't want to end up having nothing for my children's future. my first step is filing rape case against him. Right now we are waiting for the resolution. next is filing economic abuse. he never send money for about 3 mos. he wanted me to withdraw the criminal case i filed against him. next is withdrawing the annulment. I don't know how to do it. can anyone draft me a letter? do in need to mention all the details why i am withdrawing? is "due to some personal reasons" acceptable? Need help. Please.

Pwede malaman kung ano ang gusto mo manggyari? Gusto mo bang i-withdraw ang annulment o gusto mo lang palitan ang abugado?

You can withdraw your petition, magfile ka ng motion sa court para payagan kang i-withdraw ang petition mo. It does not have to state the whole story behind the withdrawal but you can at least give a brief explanation as to why.

Kung gusto mo naman ituloy ang annulment pero ayaw mo yung abugado, you can still terminate your relationship with your lawyer.

actually, ayaw ko na po tlaga ituloy ung annulment. the case is still with fiscal. ayaw na po kasing baguhin ng lawyer ung nka lagay sa petition. hindi po binaggit ang tungkol sa hatian ng properties. I don't want na ang makinabang doon ay ung papakasalan nya. we have 4 kids. ung panganay po ay college na. pinatigil ko po kasi wala po akong means to support her studies. wala na po akong access sa mga bank accounts namin. ito lang po ang paraan na alam ko to secure my children.

I hope you can help me drafting a letter. ako lang po ang mag pa-file sa rtc. the lawyer who handles this case don't respond on my request. last May ko pa po hinihingi sa kanya. sabi nya po kasi kailangan daw ng sign nya before submitting sa rtc. totoo po ba un? wala po akong lawyer kasi po di ko kaya magbayad. i even sold my car just to sustain our daily needs.

mas mabuti sigurong lumapit ka muna sa PAO para ikwento sa kanila ang sitwasyon mo. Kailangan mo rin kasi i-weigh kung ano ang mas mabuting gawin, o kung best ba talaga ngayon ang itigil ang annulment. Baka may masabi ang PAO sa iyo na ibang remedy aside from withdrawing your annulment case.
