Im a single gay man and wish to legally adopt

Hi Atty! I already have in my care a baby girl whom the mother consented for adoption. Father is already dead.

My worry is: DSWD might make it difficult for me to adopt since im single and gay eventhough im fit morally, emotionally, mentally, spiritually and financially.

If DSWD will not approve, as required by the court for legal adoption, I cant legally adopt the baby or worse DSWD will get the baby. Will they?

you will need a certification that the baby is abandoned. even better if the mother is giving consent for adoption.

unfortunately, yes, if the dswd does not deem you fit, then they have the power to take the baby. however, being gay by itself should not be the basis

Thank you AttyLLL for the prompt reply. I already have with me the signed Affidavit of Consent for Adoption from the biological mother.

With regards to my being fit as an adoptive parent im confident though sorry to say im not 100% confident with DSWD people (not all of course) who I heard are prioritizing hetero couples (thereby being discriminative) and are sometimes asking for monetary consideration (again not all).

I will try to feel the water first by inquiring at DSWD and asking around. Better safe than sorry if they discriminatively deem me not fit and get the baby. Wish me luck. Thanks again AttyLLL!
