ask ko lng po kung may habol po kami s lupang kinatitirikan ng bahay namin for 32 years...ngayon po ay pinapaalis n kami ng tiyuhin ko dahil titirhan na daw po nila at ipapagawa n din daw nila....tama po yung desisyon nila?ano pong gagawin namin ngayon po kinasuhan niya n kami ng ejectment/ejection...sana po ay mabigyan niyo po ng kasagutan ang tanong ko...maraming salamat po....god bless

whether it is at the bgy or in court, make sure that you are able to make a response to that charge.

kanina po ung first meeting sa brgy...pinakita nya po lhat ng papers s lupon ng brgy.kmi po ay walang maipakitang khit n anong papel dahil verbal lng po ang lahat noon bago p man po kmi patirahin ng tiyuhin nmin doon.after daw po ng 3rd meeting eh 1 week lng daw ang binibigay nya s amin araw at para palayasin....pano pong mgandang gawin nmin....salamat po

the bgy cannot decide who is right. offer to buy the property, and force him to file in court.

sir ang problema po nmin kng sakali ung pambayad s lawyer....pwede po lumapit kmi s PAO?kasi po un po ung sabi knina s last meeting s brgy...iaakyat n daw po ung case s court....hntayin daw po nmin ung subpoena....slamat po pa advise po ulit kng ano pong magandang gawin nmin....god bless

Hi. I am Melissa Banias, I am new here in this forum. I just want to consult regarding our case. In August 2012, my husband and I bought an NHA property from Mr. A (anonymous) for 250,000.00. Mr. A told us that the said property has an encroachment of part of the house of the neighbouring lot owner Mr. B (anonymous). So we just paid Mr. A the amount of 200,000 and the remaining balance of 50,000 will be paid if the encroachment has already been cleared. Mr. A executed contract to sell and waiver of rights in favour to both of us (my husband and I). The said property is still in the name of Mr. A in NHA’s record. However, Mr. A issued a Special Power of Attorney to both of us (my husband and I) to transact business with NHA. We want Mr. B to clear the encroachment so we brought the case to Brgy. Level for settlement but Mr. B doesn’t want to give way. He doesn’t want to clear the encroachment because according to him, he already lived there before we bought the property. I just want to ask if there’s a way for my husband and I to eject Mr. B and clear the encroachment over our property? Thank you and more power.

Pwede and PAO at pwede libre (Probono). The Lawyer will pray for the payment of certain matters against the respondent.

mas madali yang uusad kung pakakainin nyo man lng yung lawyer sa PAo! pang pagana ba:)

Ejection is a Summary Proceedings, but it depends on Court Scheduling.

When you have all the proper papers, then you have nothing to worry about.

As per @raheemerick, mag-merienda kayo minsan ng mga Friends sa PAO.

It is worth the wait.

Be careful, the other party may resort to low blows and even make up stories just to delay things.

atty good day po.. tanong ko lang mag pa file kami ng ejectment case sa 8 na bahay sa lupain namin clean title po ang lupa namin at ako lahat nagbabayad ng tax at hindi naman cla nag rerenta. pwede po ba na sa fiscal ko pahawakan ang kaso? tapos na po kami sa barangay at hinihintay na lang ang cert. to file action. mahal po kasi ang acceptance fee ng private lawyer. pwede kaya sa fiscal? o any recommendations po? salamat
