Arresto Menor

Hello,

a friend of mine (german national, permanent resident in the philippines) is being accused of child abuse, and called to a hearing to court, because he supposedly threw a stone at a child just like that, who was playing at the beach, hitting the 5 year old boy on the head near his eye, without causing any injury beside swellings.

My questions regarding this case are:

1. He (the german national) was told to get a lawyer/attorney to defend himself in the hearing. The lawyer he got now said that child abuse costs a fix amount of 75,000.00 Peso. Is that true, is there anything like a list of fee's an attorney can or even has to turn to and follow? 75,000 Peso sounds absolutely unreasonable for a case that is based on a thrown stone creating a swelling.

2. Can this really be processed as a child abuse case? I would say no, because I read that the minimum sentence for child abuse is 6 years prison, that would be a joke in this minor case.

3. If the only prove of guilt are the statements of a 5 year old boy (victim and son of accuser) and his 8 year old sister, is that enough to convict somebody as guilty?

It would be great to find some answers here, right now my friend who is accused of child abuse can't believe what is happening to him.

if he has already engaged a lawyer, these questions should be addressed to him. in settlement, any amount goes. if he doesn't think it's worth it, then he should undergo trial.

if he deliberately threw a stone at a child, then that is arguably child abuse.
