In 1992, I bought a piece of land with 197 fruit-bearing coconut trees. The purchase was with a notarized document that says that there are no tenants in my land.
Sometime ago, my father allegedly had an arrangement with his nephew for the latter to plant trees in the land. The nephew had his own son build a nipa hut in there. I had time and again reminded the nephew and his son that I own the land and not my father, but they always retort that it's not me whom they had spoken with and had an agreement with. They had chosen to ignore my assertion. I took the case to the Barangay. We did not come to any agreement. They walked out of the meeting.
My father is deceased now. They continued and still continue to use my land and its fruits for their own consumption as if they owned the land and they decide on their own on how to make use of my land and the fruits of the land for themselves, even having people I don't even know live in there. Lately the son of my father's nephew even built a concrete house in my property. Of course he did not ask for my permission because he knows that I will never allow him to do that. I called for a meeting with them twice before the Barangay. They are quoting my deceased father to the effect that they have done our own family a favor instead of us doing a favor for them by having them live and use my land for many years already.
In addition to their demanding that I pay them for the trees they allegedly planted, they are now demanding that I pay them for the concrete house they built in there. Then and only then, they will vacate my land.
The most recent argument of the nephew's son is he will not vacate the concrete house because that part of my property where he built his concrete house belongs to Transco, the company that erected a tower in a part of my land. Of course that is far from the truth. That is an excuse to evade his eventual ejection from the property because the concrete house is quite far from the tower. (Transco has not even paid me for the part of the land which it is using).
I want the illegals to completely be ejected out of my property. They already have taken so much from me. I may agree to pay for the trees but never for the house.
