hello po,tanung ko lang ko lng po kung mk2kuha na po ba ng cenomar ung 10 years separated,balak po kc nmen mgpakasal ung kinakasama ko po ay 10 years separated na,wala narin po silang communication nung dati nyang asawa 9 years na at wala na po kameng balita dun sa babae ang huling balita nya eh ngsabi na mki2pgrelasyon na sa iba??pwede na po ba mgpakasal kpag ganun lalo na kung hindi na tlga makontak at mahanap ung dati nyang asawa para mgfile ng annulment??

No. if you will go to NSO you will get the same record 10 years ago, married. Hindi basehan ang tagal na walang communication para mabaliwala ang kasal nyo, but you may use it as a ground to file a petition “Presumptive death of Spouse for Subsequent of Marriage”.

But before filing the petition, make sure that you exerted all possible efforts to locate his/her whereabouts and if the person is really dead. Try to contact their friends, relatives or last know co-workers. Also try NSO for records. This petition is not based only on the length of time that there is no communication.

Also, this doesn’t dissolve the marriage, if the person files an affidavit of reappearance, the subsequent marriage will be considered as void.
