good day po hingi lng po ako ng advice baka po matulungan nyo po ako sa problema naming mag-asawa, 2007 nagpaksal po kami after ng kasal po namin umalis din po ako agad at nag-work po sa abroad kumuha po ang misis ko ng condo/apt. at sa single status name po nya ipinangalan yung property at hinuhulugn po namin yun hangang ngayon sa pag-ibig housing sa ngayon po kailangan na pong ilipat sa panglan nya (single status name) yung property wala po bang magging effect pagnag-sign sya nung mga document para mai-transfer sa kanya yung property or may solution po ba ito? marmi pong salamat

I am Christine P. Osumo, currently residing in Bacoor Cavite. I am from Bayawan City Negros Oriental. I would like to seek for a legal advice regarding the property owned by my aunt, Julieta Pagnanawon. This property was loaned with the amount P900,000.00 in Dumaguete City Negros Oriental. Unfortunately my aunt was not able to pay for the loan when the time that a sheriff's note was received by her. She immediately informed my father to ask a favor, to pay for it because she knew that my father had funds. At first my father was hesitant to pay for it because he was using for his business, but because of his brotherly love for his sister he sacrificed his money and all the savings he had after retirement, because my father is a retired chief of police in our province and was able to save funds from his 36years of service. My father paid for the amount P900,00.00 so that he would be able to save the lot owned by his sister, after given the promise that she will pay for it if the lot will be sold in the future. Unfortunately, last year that was March 30, 2011, my father died of an accident. What were left in us were the original title of the lot named after my aunt Julieta Pagnanawon, with letter of authority to sell, and the receipts paid by my father amounting to P900,000.00. Now, we are trying to negotiate it with our aunt, but she does approve of the 50-50 share, wherein she gets 50% of the total amount of the lot to be sold. I would like to seek for an advice of what is the right thing to do, and what are our chances to be able to get a fair share, because it was our father's savings. And we really need this to be able to pay for the balance of the lot where our family resides now, and for other financial obligations to be paid. Thank you and I hope to hear good advice from you. Hi po, gud day. Ask ko lang po kng ano po ba tlga ang magandang gawin sa ganitong situation.

My Grandparents bought several land properties, some properties are transferred to the siblings, some are not. Ngayon po, wala na yung mga grandparents ko about 6-10yrs ago, then last year, namatay po papa ko. Dumating ngayon yung mga tita ko (siblings of my father) galing sa States, right after ng libing ng papa ko last year, pinaalis kami sa bahay na tinitirhan namin kasi hindi daw amin yun. matagal na yung issue na ito, so pumayag kaming umalis para walang gulo. Today, one of my titas claimed na kanya na daw yung entire property, pinapadalhan kami ng mga kung ano2ng sulat galing sa lawyer nila.

Ang naging kasunduan is hatiin lahat ng properties equally to seven (7 sila magkakapatid-ng papa ko). pero kinukuha nila ang lahat, wala na daw kami share dahil di daw nabayaran ng father ko mga taxes nung lupa kasi siya lang ang naiwan dito sa pinas.

Ngayon po, nalaman ko na pinarentahan na yung buong second floor. Legal ba ito? na tinransfer nila sa mga pangalan lang nila lahat ng nagrerenta sa baba pati ngayon, mukhang wala silang balak ishare ung renta sa taas.

Ano po pinakamagandang gawin?

Nakailang lipat na kami ng lawyer (na kusang tumutulong sa amin pero mukhang kinalimutan nrin kami) pati yung matalik na kabigan ng papa ko na lawyer din, parang binenta narin kami kasi sya mismo nagsabi na ok umalis nlng kami sa property na yun at pirmahan lng namin yung agreement.

Hirap na po mama ko, pati kami ng ate ko. hindi nman kami mayaman para makapagbayad ng lawyer tlga na tututukan kami.
