I am Christine P. Osumo, currently residing in Bacoor Cavite. I am from Bayawan City Negros Oriental. I would like to seek for a legal advice regarding the property owned by my aunt, Julieta Pagnanawon. This property was loaned with the amount P900,000.00 in Dumaguete City Negros Oriental. Unfortunately my aunt was not able to pay for the loan when the time that a sheriff's note was received by her. She immediately informed my father to ask a favor, to pay for it because she knew that my father had funds. At first my father was hesitant to pay for it because he was using for his business, but because of his brotherly love for his sister he sacrificed his money and all the savings he had after retirement, because my father is a retired chief of police in our province and was able to save funds from his 36years of service. My father paid for the amount P900,00.00 so that he would be able to save the lot owned by his sister, after given the promise that she will pay for it if the lot will be sold in the future. Unfortunately, last year that was March 30, 2011, my father died of an accident. What were left in us were the original title of the lot named after my aunt Julieta Pagnanawon, with letter of authority to sell, and the receipts paid by my father amounting to P900,000.00. Now, we are trying to negotiate it with our aunt, but she does approve of the 50-50 share, wherein she gets 50% of the total amount of the lot to be sold. I would like to seek for an advice of what is the right thing to do, and what are our chances to be able to get a fair share, because it was our father's savings. And we really need this to be able to pay for the balance of the lot where our family resides now, and for other financial obligations to be paid. Thank you and I hope to hear good advice from you.
