may pinagkakautangan po ako ng 3.5k tinatakot po nya ako na idedemanda daw,posible po ba ito??sabi ko naman sa kanya na babayaran ko din pag naka luwag luwag ako,sabi nya pag nag bayad daw ako bibigyan daw nya ako ng affidavit of desistance,pag ganun po ba it mins may kaso na ako sa fiscals office?

yung pinsan ko po nangutang ng 13000 hindi niya nabayaran tapos po tinatanggi po..nangutang po ng walang kasama o pirmahang ngyari...ngayon po text ng text yung pinagkautangan sabi daw po kakasuhan ng estafa hinintay po namin nakaraan po ang 1 buwan ngtext po ulit sabi nya po hintayin na lang ang subpoena...pwede ba syang kasuhan ng subpoena ng hindi na dumadaan sa baranggay namin..ano po ba ang proseso para makapag subpoena

The victim of your cousin would file his/her complaint affidavit at the prosecutor's office. Then the prosecutor would issue a subpoena against your cousin. If the victim and the perpetrator are not of the same municipality or of adjacent barangays of two different municipality, the requirement for conciliation before the lupon may be dispensed with.

good day po tanong ko po pag nag file po ng subpoena gaano po katagal ang proseso..may nakukulong po ba sa estafa...kapag estafa po ba subpoena po agad hindi po ba kailangan dumaan muna sa baranggay

ang taong napatunayang nagkasala ng estafa ay nakukulong. sa office of the fiscal fina-file ang complaint for estafa.
