how do I severe a lock in period contract

Dear Sir/Madam:

I have been using an internet broadband service from SmartBro fo rmore than 5 years now at a cost of P1000 per month. The system installed by Smartbro in my residence was a fixed wireless system using an aerial “canopy” type. Smartbro is among the first to introduce the broadband service in my area hence I was among those who first subscribed to their service. The service quality at the start was very poor hence I have to complain a countless times but Smartbro was able to fix it and the internet connection was within a tolerable limit and so I stayed with Smart for more than five years.

But Lately their services turned from bad to worst. Aside from a maddening very slow internet speed, I was already experiencing difficulty in connecting with the system and when connected I was confronted with frequent disconnection. I complained this to Smartbro and they sent their Maintenance Service Subcontractor to look into the problem. To my very surprise, the honest subcontractor informed me that there is no problem with my PC nor my Antenna, accordingly the problem is no other than with Smartbro management themselves as they keep on accepting more and more subscriber to a system that has exceeded its maximum limit. Again according to the maintenance crew, in my service area for example, the system can only accommodate a maximum of 60 subscribers but the subcontractors were instructed to double or even triple the number hence they keep on installing fixed wireless system as they are paid for.

The maintenance crew finally suggested that I “migrate” to smartbro WIMAX as there are still few subscribers hence I may be able to get a better internet service. To cut this story short… I did.
Unfortunately, the WIMAX is no better than the old “canopy” type as its very “maddeningly” slow despite the tweaks and reconfigurations by Smartbro reps.

I am now fed up with smartbro and so I wanted to look into other Internet Service Providers but I was warned by Smartbro that I signed a two (2) year “lock-in” period with them. Accordingly, I can discontinue using their internet services provided I return the WIMAX device and pay the remaining 22 months that I have yet to use! Is this even FAIR? Is there a way than I can severe the lock-in period?

I would really appreciate your advice.
