My sister got an existing housing loan thru pag-IBIG to one of the Developer. She needs money thats why she is selling me her house and lot which now named to her when she was still single and still got monthly amortization. By the way she is married now. Does her husband signature is still needed? We agree that I would pay her installment for the Amount of Php 100,000.00 Please help me what are the papers that we need, to make it legal.

Since you are paying on installment, you can execute a Contract to Sell with the following provisions: (1) purchase price; (2) terms of payment; (3) who will shoulder the taxes; (4) that the sellers and the buyer shall execute a Deed of Absolute Sale once you have fully paid the purchase price. You can include any other terms as you may deem necessary.

Once you have fully paid, you and the sellers will execute the Deed of Absolute Sale.

You need to include her husband in the agreement for your protection since the property is presumed conjugal. Otherwise, the husband can claim later on that he did not give his consent to the sale.
