Good day! Gusto ko po magtanong tungkol sa tamang pagpapa-upa ng apartment. Sa kasalukuyan kami ay nangungupahan ng apartment dito sa paranaque sa halagang 8,000.00 kada buwan. Ang napagkasunduan ay kami ay dapat magbayad in advance kada buwan, tuwing 1st hanggang 5th ng buwan ay dapat kami mabigay ng renta para sa buwan na tatakbo. Pero may mga di maiiwasang insidente na minsan kami ay nadedelay ng bayad pero naibibigay din naman namin bago pa man matapos ang buwan na itinatakbo. Ang aming lanlord ay pinipilit kami na mag-issue sa kanila ng mga post dated cheques ngunit kami ay tumututol sa dahilang unang-una wala kami checking account at ayaw namin magka-problema ng bouncing check. Nagpupumilit ang landlord na mag-issue kami or dapat namin evacate ang apartment. Oo nga at may mga pagkakataon na delayed kami ng bayad pero ung para sa renta na itinatakbo sa buwan na due namin. Di naman masasabing deliquent kami dahil bago pa man matapos ang buwan ay naiaabot namin ang upa. Ang isang nakakapagtaka ay ang mga resibo na binibigay namin para sa binayad namin sa upa ay resibo na nabibili sa bookstore or di kaya ay voucher o simpleng papel. 4 doors na apartment po ang pina-uupahan nila. Di po ba kapag mga ganitong klaseng pagpapa-upa ay kailangan nila mag-issue ng official receipt na aprobado ng BIR?

Sana po ay matulungan at mabigyan nyo kami ng payo sa kung ano dapat naming gawin sa pang-gigipit ng aming lanlord. Maraming salamat po.

hello po. we have been renting an old appartment for the last 20+ years. my father and the landlord had an agreement that the vacant lot adjacent to our appartment will also be rented. in fact, it was the vacant lot which "sealed" the deal for us to rent the old appartment. we spent a lot restoring the appartment but did not ask the landlord for any reimbursement. the landlord passed away and his son took over the management of the apartment. the son informed us that since original landlord (his father) passed away, he will change the arrangement and will now take back the vacant lot which we have converted into a garage.the fact that the original agreement and the basis for us renting the old apartment is the vacant lot, can the son really take back the vacant lot and change the original arrangement? we are paying rent for the vacant lot which turned out to be government property by the way. can't the original agreement stand since only the other party was deceased? thanks po.
