Hi! I would like to seek a legal advice on what my sister's family can do to file complaint against the doctors who attended to my nephew's medical condition just this week.

Last Sunday morning my nephew was rushed to the ER of a hospital here in Cavite due to severe stomach ache and vomiting. He was confined that day. He was x-rayed and a CBC was done the following day, Monday, i think in the afternoon. They initially ruled out appendicitis since the symptoms were not of appendicitis daw, as the doctors said. Then they said he would be under observation, not giving him food or anything to drink for several hours. Then a day or so they said it could be acute gastroenteritis, they were giving him probiotics. He goes to the toilet more than 20 times a day to poo! Still he was not given any medicines. My sister and her husband were so worried and I told them to try to transfer him to another hospital. By wednesday night I already got so fed up with these doctors that I really had to make a scene at the pediatric hall shouting at them for not attending to my nephew. They were still claiming that it was acute gastro but the bacteria found in his stool is not enough to require antibiotics. My sister told them that if they still doesnt do anything or give us any concrete findings as to what is the real condition of my nephew we will transfer him the next day but we will not sign a waiver of release. By thursday morning the surgeon assigned to him had him xrayed again and saw that there was something blocking his intestines. They had to operate, and when they finally opened him the surgeon saw that his appendix has raptured already, that it was not an intestine blocking an intestine but a pus. They said that his appendix might have raptured as early as sunday. After the operation, my nephew has to be put in the ICU because he has difficulty in breathing and the doctors had closely monitored hte infection caused by the raptured appendix. He has tubes down his throat! My God, when I saw him lying on that bed with those tubes inside him...if only curses in my head can kill I've already killed those doctors!
These should not happened to my 13-year old nephew had the doctors were competent and jsut did what they have to do..kaso hindi...obviously they were incomptent! And to think this hospital is not a small one, this hospital is one of the best (as they claimed)and the biggest in cavite with their state of the art medical equipments. And we were paying, were not a charity case. Just imagine what they could do to those who where at their mercy!
Please if any one of you can give me an advice or whom should we go to to assist us because this is clearly a MEDICAL NEGLIGENCE! I will wait for your replies. Thank you!

if you were to file a case against them, you will need other doctors acting as expert witnesses, and they will have to testify that the normal standard of care was not applied.
