Hi Good day,

Im a regular employee of a BPO company . I am under suspension . Is it legal to hold my salary ? I was suspended after the salary cut off day. I was told by the HR that they will hold the salary until the decision will be made.. Need help lang po./.thanks.

i would argue that if there are days that are worked but not yet paid then you should be entitled to get your pay. but for the period of suspension, you will not be paid unless exonerated

Yes there were worked days that wasnt paid yet. they told me that it will be hold since im under suspension..

you can file a complaint at nlrc to claim your pay, but you may want to wait a bit if there's a good chance you will be cleard

hi atty,

my issue is that the previous company i worked with held my salary which is supposed to be today, April 25, 2012. They gave me my end of contract letter yesterday, April 24, 2012. But, the cease employment effectivity is dated today, April 25, 2012. They told me that I would only get the said salary on my last pay check(2 months after). I never experienced this kind of issue before on my previous jobs. The salary that was held was for the April 1-15 cut off (the last day I came to work was yesterday). I thought that the only salary they can hold is for the April 15-30 cut off. Is it legal for them to do that? Is it still possible for me to get my salary by this week or the next? I'll await your kind reply. Thank you

in addition po pala atty, my employment status before i got terminated is probationary. I was on training from jan-feb. from feb4-april 25, i'm on th probationary status. Should they have given me a 30-day notice before they terminated me? ok lang naman po or them to terminate me effective immediately. it's just the salary hold which i cannot understand.

i'm a bit thankful narin po kasi they onLy tagged me end of contract daw po instead of terminated.ang reason daw po why they're hoLding the salary is because the salary is reaL time daw.. walang naka- "pondo".

if they finished the 6 month period, but you did not pass the standard then that's fine. the holding of salary is standard for severed employees.
