HOW TO FILE CASE AT HLURB UNDER MACEDA LAW

HI I am a buyer who back out of my contract at Empire East Land Holdings Inc. I have 40 months of installment and as my rights under Maceda Law i am clearly entitled to get a 50% refund of the total payment i have made.

I already hired a lawyer but the lawyer just sent a letter to Empire East and unfortunately, Empire East did not comply to settle directly to them. They want me to file a complaint from HLURB and from there dun lang sila mag cocomply...

Ang tanong ko sana papaano ba mag file nang complaint sa HLURB under maced a law. Ano ang procedure and do i really need to hire a lawyer para sa complaint ko thanks a lot?

please edit your post because this is in the level of libel already.

you have to prepare a complaint pleading, pay legal fees. if you want to operate on yourself without a doctor, then you can go at it without a lawyer.

for my advise and according in our law you don't have to bypass our judiciary system you need to complaint in HLURB for this legal matter after that they will applied in court in-case bout party fail to
agree in settlement .
and you asking for complaint letter for HLURB the answer is yes type in google search hlurb sample complaint letter and you will find the format.
and one things you dont need to pay anything in HLURB

I need help regarding my house & lot. I have been paying installments for nearly 4 years and I wasnt able to pay anymore for the past 4 months.
They already sent me a final demand letter.
I think I am not capable of continuing the installments anymore.
I want to file for the Maceda Law so I can at least get 50% of what i paid.

Here are the details:
Total contract price - PHP1.6M
15 years to pay thru in-house financing
Downpayment made was 10% of the TCP
Monthly amortization made every month is P26,200
I started paying my monthly amort. on August 2009
I wasn't able to pay last June 2013.
I paid total of 3 years and 9 months.
26,200 x 45 months = PHP 1,179,000
That does not include the 160,000 downpayment I made before moving in.

What do you think are the chances of winning the case?
I am so confused whether to hire a lawyer or just give it up just like that.
I am just an OFW and I cant be there to settle matters.

If you want to file with HLURB, I suggest you better do it with a lawyer coz if you don't you'll be eaten alive.

Take it from me who had a first hand experience.
