Amendment of Visitation or Settlement

Last year my brother and the mother of his child had a case reg the settlement for their illegitimate child. The aggreed that they the child can go to our home provided that maternal grandmother comes with his child that will be twice a month. However, the mother of the child left for dubai and sometimes the grandmother doesnt want to come to our home hence my nephew as well. My brother pity his child since his
Mother is no longer at his side an my brother feels that it would be important for the child to have a parent with him. We dont plan on getting the child's custody, only an amendment of the settlement, say, amend it to have the child stay with us on weekends even without the grandmother. Wht shall we do and what do we need to file?

We have already talked to her atty and she doesnt want to ammend it. We are not after the custody of my nephew we told her that we would like to amend it from originally twice a month for te child to be with his father change it to every weekend since the mothet went to dubai already.naawa lang po ung brother ko kse wala na nga po ung mother sa tabi nya, twice a month lang po nya nakakasama dad nya. Gusto lang po maparamdam ng brother ko sa anak nya na may magulang sya. Kahit na ksama nya po ung maternal grandmother nya iba pa din po kse ung parent.

then your remedy is to file a case for enforcement of visitation rights or even custody if only to force them into a settlement

However the mother is in dubai..will she be required to come home here in te philippines? What if she doesnt wabt to come here will the case progress?

Can she have her mother, the maternal grandmother of my nephew attend to it behalf of her though an SPA?

yes, she can issue an SPA, but let them worry about that
